Ex-director, brother to appeal decision to pay legal fees By Suraini Andokong
KOTA KINABALU: Former director of Sabah State Water Department and his brother cum his surety will appeal against a court order to pay the remaining RM30,000 in legal fees.
In a press statement, counsel Marcel Jude Joseph, who represented Ag Mohd Tahir Mohd Talib and his sibling Ag Mohd Fauzi@ Ugi, disclosed that his clients would file the appeal within 14 days starting from yesterday against the said decision.
On March 26, the Magistrate's Court here ordered Marcel's clients to pay the said remainder in legal fees to a firm that represented the former director in an application to vary the terms of condition of his bail order in 2017.
Magistrate Afiq Agoes made the order after allowing an application filed by Messrs Nohin and Partners against the duo including RM3,325 costs to be paid to the firm.
On October 16, 2018, counsel Pg. Amli Noraufe Datuk Hj. Pg. Nohin, who represented the firm, had filed an Order 14 Rule 1 of the Rules of Court 2012, naming Ag Mohd Tahir and Ag Mohd Fauzi as the first and second defendants respectively.
In the notice of application, the firm sought an order from the court to be granted a final judgement against both the defendants jointly and severally for the sum of RM30,000, interest at the rate of 14 percent per annum from July 6, 2017 being remainder of legal fees and costs.
In the said application, the firm claimed that both the defendants had no defence to the firm's (plaintiff's) claim.
Previously on July 6, 2017, the same firm had filed a suit against both the defendants claiming the same reliefs whereby the application for Order 14 was based on the suit.
