Salesperso­n jailed, fined for CBT

KOTA KINABALU: A 39-year-old man was sentenced to 18 months jail and fined RM3,000, in default, six months jail for committing criminal breach of trust involving RM11,550 being monies collected for sales of motor oil.

Judge Noor Hafizah Mohd Salim imposed the sentence on Johnrie Jumari after he admitted to committing the offence when the case was mentioned in the Sessions Court here yesterday.

Johnrie, in his capacity as a salesperso­n at the E.M Technology Marine Sdn Bhd, had allegedly breached the trust of the company on the sales collection of motor oil, YAMALUBE, for his own use. The alleged offence took place at the premises in Jalan Segama here at 4.30 pm on April 27.

Johnrie was charged under Section 408 of the Penal Code, which provides for a jail term of up to 14 years and whipping and also liable to a fine, upon conviction.

The facts of the case stated that customers had gone to the premises to complain about not receiving the motor oil which they had paid for and provided their payment receipts to support their case.

Upon checking further on the matter and after meeting the accused for confirmati­on, it was revealed that he had used the money to pay for his loan.

In mitigation, Johnrie, who was not represente­d, pleaded to the court for leniency as he has five children to support and he was remorseful of his act.

Deputy public prosecutor Megat Mahathir Megat Tharih Affendy, however, urged for a deterrent sentence taking into considerat­ion the seriousnes­s of the offence.
