Former cook gets 17 years, 10 strokes for raping stepdaughter
KUCHING: A former cook was sentenced to 17 years in prison plus 10 strokes of the cane by the Sessions Court here yesterday for raping his stepdaughter.
Judge Jason Juga however granted the application filed by the accused’s lawyer Francis Teron for a stay of execution of the imprisonment and whipping, and allowed the accused to be released on bail of RM20,000 with two local sureties.
The 36-year-old accused was also ordered to report to the nearest police station on a weekly basis pending the disposal of his appeal.
The court had earlier convicted the accused under Section 376B of the Penal Code a er the defence failed to raise reasonable doubts at the end of its case.
The imprisonment term will take effect from the date of arrest on Nov 6, 2018.
The accused was charged with committing incest with his 10-year-old stepdaughter at around midnight on Oct 1, 2018.
Based on the brief facts of the case, the victim was sleeping in the dark in the living room when the accused caressed the victim and opened her pants before raping her.
The victim was said to be unable to defend herself as she feared the accused.
The victim had also claimed that it was not the first time such an incident had occurred.
Also representing the accused in the case was Timotius Ngau Wan while Deputy Public Prosecutor Nur Fadzlin Mahmad Zulhasnan prosecuted.
A total of eight prosecution witnesses and three witnesses from the defence were called to testify at the trial.
