Three waiters claim trial to stealing food from restaurant

KOTA KINABALU: Three waiters claimed trial in a Magistrate’s Court here on Thursday to a joint charge of stealing food from a restaurant.

Dixonn Daimin, 18, Matius Joseph, 25, and Jackey Anak Ereson, 20, who appeared before magistrate Stephanie Sherron Abbie, were charged under Section 380 of the Penal Code, read together with Section 34 of the same Code.

The indictment provides for a jail term of up to 10 years or a fine, or both, upon conviction.

The charge stated that the trio had allegedly stolen two pieces of frozen fish, three canned drinks, two packs of scrambled salted eggs, two packs of pork meat, two packs of prawns, two bottles of sauces and three canned evaporated milk belonging to the restaurant in Luyang between 2.34pm to 2.40pm on March 28.

The court fixed May 17 for case management.

The trio was released on a bail of RM1,000 with two local sureties each.

National Legal Aid Foundation counsel Lim Ming Zoong @ Lawrence represente­d the three accused.

In another Magistrate’s Court here, a parking attendant was jailed for 20 months for attempting to steal a car battery.

Magistrate Lovely Natasha Charles imposed the sentence on Kho Lok Sun, 31, after he admitted to trying to steal the item at a house at Jalan Penampang on Jan 9.

The court also ordered for the physical exhibit in Kho’s case be returned to its rightful owner.
