Mat Malaya ordered to enter defence over shooting charge

KOTA KINABALU: A man dubbed as Mat Malaya was ordered to enter his defence by the Sessions Court here on July 14 - 15 this year for a charge of shooting a mechanic.

Judge Azreena Aziz made the decision on Mohd Jusnaidi Omar, 45, after the prosecutio­n had establishe­d a prima case against the accused on a charge framed under Section 324 of the Penal Code.

The indictment carries a jail term of up to 10 years or a fine or whipping or any two of such punishment­s upon conviction.

She ruled that the prosecutio­n had failed to establish a prima facie case against Mohd Jusnaidi for his initial charge framed under Section 307 of the Penal Code, which is punishable with up to 20 years’ jail, on conviction.

Therefore, he was discharged and acquitted from the charge of a murder attempt towards one Alkarim Atun, 36, at an airconditi­oning centre along Jalan Tuaran Bypass here at 5pm on May 6, 2015.

An amended charge under Section 324 of the Penal Code was then read to Mohd Jusnaidi of voluntaril­y causing hurt towards the mechanic using a firearm at the same time and place and he (the accused) pleaded not guilty to the charge.

Counsel Ronny Cham, who represente­d Mohd Jusnaidi, prayed for the court to grant his client bail while deputy public prosecutor ( DPP) Akmalzatul Mohamed Nawi objected to bail due to Mohd Jusnaidi’s previous attempt to abscond.
