Labourer found guilty of abusing daughter

KUCHING: A labourer was found guilty in the Sessions Court here yesterday for abusing his biological daughter two years ago.

Judge Dayang Ellyn Narisa Abang Ahmad deferred the sentencing to tomorrow (Thursday) after the accused Norizan Edi submitted his mitigation as well as the reply from the prosecutio­n.

Norizan, 43, from Semariang in Petra Jaya was found guilty of inflicting injuries to his 14-yearold daughter at his house on Feb 16, 2015 at about 4pm.

The judge ruled that his defence had failed to raise reasonable doubt on the prosecutio­n’s case after a prima facie case against him was establishe­d.

He was charged under Section 31(1)(a) of the Child Act 2001 which provides for a maximum fine of RM20,000 or a jail term of up to 10 years, or both, upon conviction.

Hani Iryani Bonny and Abdul Rahman Mohd Hazmi defended the accused while DPP Haresh Prakash prosecuted.

In another Sessions Court room, the judge adjourned the case of a man charged with causing the death with negligence of his former girlfriend to May 16 pending chemist report.

Judge Timothy Finlayson Joel made the decision on Chiam Tat Huat, 34, during the case’s pre-trial management.

He ordered the accused to be further remanded in prison pending the disposal of the case.

Chiam was charged with committing culpable homicide not amounting to murder on the deceased on Dec 24, 2009 between 6am and 5pm at a house at Bukit Bayor here. He will be tried under Section 304(a) of the Penal Code, which carries a maximum penalty of 30 years’ jail and/or a fine upon conviction.
