Developer ordered to compensate house buyers for late delivery
KUCHING: Sarawak Housing Purchaser Claims Tribunal has ordered a developer to pay a total of RM25,600 to four house owners for late delivery of their homes here, yesterday.
Dato Maznah Dasmi presided over the claims hearing, assisted by panel members Peter Lim Thiam Seng and Robert Elone Sireng.
Maznah said, “The claimants had to complain to the tribunal because of the delays and defects such as in wiring and plumbing in the houses.
“The tribunal has decided that the claims are all valid and the penalty as stated according to the Sales and Purchase Agreement ( S& P) should be awarded to the purchasers.”

She was supposed to receive the key to her house on Nov 27, 2014.
Maznah explained, “As long as the delivery of the property is delayed, the penalty continues.
“As for the second claimant, her property was delayed for 29 months and by right she should receive RM11,600.”
However, Maznah stated the second claimant has signed a deed of settlement with the developer which the tribunal did not recognise.
“Nonetheless, an amount of RM4,400 has been given to the claimant because of the deed. She should be awarded the remaining RM7,200.”
The tribunal has ordered the developer to pay the third claimant RM5,200 after a delay of 17 months.
The fourth claimant will receive a compensation of RM4,200 after a delay of 18 months.
Both third and fourth claimants have received a compensation of RM1,600 and RM1,200 respectively after they signed deeds of the settlement with the developer prior to the hearing.
Three of the properties are located in Landeh and another one in Kota Samarahan.
According to Maznah, the handing over of properties to home owners was supposed to be done within 24 months after the signing of S& P.
