Developer ordered to pay RM23,890.16 for delayed completion of property units

KUCHING: The Sarawak Housing Purchaser Claims Tribunal yesterday ordered a developer to pay condominiu­m buyers a total of RM23,890.16 for delayed completion of property units and common facilities.

In the first case, Tribunal chairperso­n Dato Maznah Dasmi awarded Ngui Fui Heng RM17,956.08 for late completion of his unit based on the formula allowed by the Tribunal.

Ngui, who bought a condominiu­m at Jalan Wan Alwi, was claiming 256 days of late delivery of his unit. The Tribunal awarded him 136 days of claim after deducting 120 days of delay by requiremen­t of authority.

In the second case, Chin Ying Ying who owns two units of the

condominiu­m is claiming for common facilities delay. The Tribunal announced that new facts were discovered and a decision would be made later.

In the third case, the Tribunal directed the developer to pay Tan Hong Choo RM5,934.08 for the delay in the handling over of property. He was claiming 158 days of late completion of his unit, but he was awarded claim of 38 days after deducting 120 days of delay by requiremen­t of authority.

The respondent (the developer) must pay the claimants within 45 days after receiving decision letter from the Tribunal.

Also present were Tribunal deputy chairman Peter Lim Thiam Seng and member Robert Elone Sireng.
