Accident victim’s family to sue DBKU and state government for negligence

KUCHING: The family of motorcycli­st Dina Dzulkarnai­n Asan, who was killed in an accident at Padang Merdeka last month, has begun legal proceeding­s against the relevant authoritie­s for alleged negligence.

Padungan assemblyma­n Wong King Wei said Dina’s father has sought help to initiate proceeding­s against Kuching North City Commission (DBKU) and the state government.

“We are now compiling all the necessary evidence including photograph­s of the scene before and after that accident.

“And of course, we are also compiling other relevant documents such as police reports and autopsy report before we initiate the legal process,” Wong told reporters yesterday.

According to him, the Public Works Department’s safety guidelines were not adhered to at the site.

He said family members, particular­ly Dina’s father, had stressed that compensati­on was secondary.

“What is more important is that a lesson must be learnt by all the public authoritie­s, especially when they are carrying out any constructi­on in a public place or on a public road.

“The public authoritie­s must make sure that safety measures are well taken care of so that the unfortunat­e incident or fatal incident would not be repeated in the future,” he said.

Dina is believed to have died after the motorcycle he was riding skidded and plunged into a metre deep hole for an ongoing flood mitigation project at Padang Merdeka on Dec 26.

T he 29-year- old was found submerged in the water by members of the public.

He is survived by his widow Azalilah Abdullah and two children – aged three years and one-year-and-seven months.
