Businessman on rape charge, single mum to be tried Feb 2

MIRI: The Sessions Court here yesterday fixed Feb 2 for further mention of a joint trial of a prominent businessman with the title ‘ Dato’ charged with raping a 12-year- old girl, and a single mother who is charged with prostituting the same girl to the businessman.

Judge Steve Ritikos also ordered the date of the trial fixed earlier for March 5 to 9 be maintained.

The accused – Dato Ibrahim Ahmad Darvesh Mohd Deen @ Ibrahim Din, 82, from Piasau Jaya Phase 1 and Ayu Abu Bakar, 31, from Kampung Lereng Bukit – were subsequently allowed to be released with a further RM15,000 bail each with two local sureties pending trial.

Ibrahim allegedly raped the underage girl in two separate budget hotels here at 12.40am on Aug 31, 2017 and another, about 8pm on Sept 11, 2017.

For the first offence, he was charged under Section 376 (2) ( D) of the Penal Code which carries a jail sentence of not less than 10 years and not more than 30 years, and liable to whipping upon conviction.

For the second offence, for allegedly raping the same girl, he was charged under Section 376 (1) of the Penal Code which provides a jail term of up to 20 years and also liable to whipping, upon conviction.

Meanwhile, Ayu faced three charges of prostituting the 12year-old girl to Ibrahim

Ayu, who is charged with one offence under Sub- Section 372(1)( d) of the Penal Code and two offences under Sub- Section 372(1)(a) of the same Code, could be jailed up to 15 years and whipping, and shall liable to a fine, for each of the offence on conviction.

Ayu allegedly committed the first offence about midnight on Aug 31, 2017 at a budget hotel here, by wrongfully restraining the victim in a room with the intention that the victim has sexual intercourse with Ibrahim.

The second offence was committed at the same hotel on the same date and time, and the third offence at another budget hotel at 8pm on Sept 11, by prostituting the girl to Ibrahim.
