Unemployed man jailed eight months for causing hurt to his wife

SIBU: An unemployed man was sentenced to eight months in jail by the Sessions Court here yesterday after he pleaded guilty to voluntaril­y causing hurt to his wife.

Mohamad Haswandi Hamdi, 44, was charged under Section 323 of the Penal Code, read with Section 326A of the Penal Code, which provide for up to a year jail, or with fine which may extend to RM2,000, or with both.

Haswandi also pleaded guilty to a charge of child abuse, and was fined RM2,000 in default three months’ jail.

He was also ordered to undergo two years of good behaviour bond of RM3,000 with one local surety.

The child abuse charge is framed under Section 31(1) of Child Act 2001 which carries a fine not exceeding RM50,000 or jail term not exceeding 20 years or both, and shall also be ordered to execute a bond of good behaviour.

The sentences are to run concurrent­ly from the date of his arrest.

It is said that about 2pm on Jan 10 at a rented room in Tun Ahmad Zaidi Adruce Lane 39, here, a misunderst­anding happened between him and his wife Juliana.

Haswandi hit Juliana on her face, chased her and threw stones at her. One of the stones hit his daughter on the cheek.

Juliana lodged a police report at 4.35pm the same day at a police station in Ulu Lanang, which then led to the arrest of the accused in front of a coffee shop in Tun Ahmad Zaidi Adruce Lane 39, the same day.

The couple has been married since 2000 and they have four children.

Juliana works as a catering assistant while Haswandi is unemployed.

Haswandi was under the influence of alcohol during the incident, but was still aware and conscious of what were happening then, the court was earlier told.

The incident was witnessed by his son. The incident happened because Juliana demanded a divorce from him as she was subjected to frequent beating whenever he was under the influence of alcohol. The accused is said to be hot tempered.

Before the sentencing, Haswandi said he felt remorseful of his offence and promised not to commit it again.
