Drug traffickin­g and possession cases transferre­d to High Court

MIRI: The Magistrate­s’ Court here yesterday ordered for cases involving two women accused of drug traffickin­g and drug possession to be transferre­d to the High Court.

Magistrate Zuraini Ali Musa also ordered for Lily Kunyang, 34, from Vista Perdana, and Freska Musa, 32, from Lutong, to be detained at the Miri Central Prison while waiting for further mention of the case.

In his applicatio­n, prosecutin­g officer Insp Mohd Khairi Mohd Noor said deputy public prosecutor Nur Isla Abdul Latif had called for the case to be transferre­d to the Miri High Court.

Lily and Freska are charged under Section 39B ( 1)( a) of the Dangerous Drugs Act 1952 for traffickin­g in dangerous drugs, which is punishable under Section 39B of the same Act, read together with Section 34 of the Penal Code.

The Section provides for the death penalty upon conviction.

Lily and Freska allegedly trafficked methamphet­amine weighing 102.10 grams at 2.15pm on Feb 13 at a house in Vista Perdana, Permyjaya.

They also face two other charges under the Act – being in possession of methylened­ioxymetham­phetamine (MDMA) weighing 20.35 grams as well as ketamine weighing 126.04 grams, both at the same time and place.

For the first offence, they are charged under Section 12 ( 2) of the Dangerous Drugs Act 1952, which is punishable under Section 39A (1) of the same Act, and read together with Section 34 of the Penal Code.

If found guilty, they could be jailed for between two and five years, as well receive three to nine strokes of the rotan.

For the second charge, Lily and Freska face a charge under Section 12 ( 2) of the Dangerous Drugs Act 1952, which is punishable under Section 12 ( 3) of the same Act.

The Section provides for a fine of up to RM100,000, or maximum five years in jail, or both.
