SHAH ALAM: A businessman was charged in the Magistrate’s Court here yesterday with cheating another businessman of RM5,000 for an instrument on the conferment of Pahang state award, which turned out to be false.

Wan Yon Ann, 34, however, pleaded not guilty to the charge before Magistrate Rini Triany Muhamad Ali.

Wan was charged with cheating Tan Wai Khan, 40, into believing that the instrument on the conferment of the Darjah Kebesaran Indera Mahkota Pahang ( D. I. M. P), which was handed to him by Wan was genuine, prompting him to hand over RM5,000 to the accused.

The offence was allegedly committed at a house in Jalan BRP 7/3B, Bandar Rahman Putra, Sungai Buloh, near here, at 9.30 pm last Aug 18.

The charge, under Section 420 of the Penal Code, provides for imprisonment up to 10 years, whipping and fine, if found guilty.

Wan also pleaded not guilty to an alternative charge, made under Section 471 of the Penal Code, with using as genuine the forged instrument on the conferment of the award, at the same place, time and date.

He faced an imprisonment for up to two years, or fine, or both, if found guilty.

Selangor deputy public prosecutor Khairul Aisamuddin Abdul Rahman, who prosecuted, offered bail at RM10,000, but Wan’s lawyer, Wan, Shalehhuddin Salam (rpt: Shalehhuddin) requested for the bail amount to be reduced to RM5,000.

Shalehhuddin said Wan had a wife and two children to support, and his father, who is a disabled person and his bailor, had high blood pressure.

The court the set bail at RM6,000 in one surety and fixed Nov 9 for case management. — Bernama
