Man ordered to undergo a month’s mental observatio­n

SIBU: The Sessions Court here yesterday sent a 23-year- old man charged with voluntaril­y causing hurt by dangerous weapon to Sentosa Hospital, Kuching for a month of mental observatio­n.

No plea was taken from Nicholas Allery Richard when he was produced in court yesterday.

Deputy public prosecutor ( DPP) Mohamad Zulfadhli Tuah applied for the mental observatio­n on the accused, and was granted by Deputy Registrar Stella Augustine Druce under Section 342 of the Criminal Procedure Code.

Nicholas will be produced in court again on Feb 11.

He was charged under Section 324 of the Penal Code, read together with Section 326A of the same code, which (Section 324) carries up to 10 years’ jail or with fine or with whipping or with any two of such punishment.

Under Section 326A, the accused may be jailed for a term twice as long as the maximum term for which he would have been liable on conviction for that offence under the relevant section upon conviction.

Nicholas is alleged to have intentiona­lly inflicted injury on his stepfather with a knife about 4.30pm on Dec 29 last year at a house in Wawasan residentia­l area here.

Meanwhile, the owner of an entertainm­ent outlet was fined RM8,500 in default seven months’ jail by a magistrate’s court here yesterday after he pleaded guilty to operating the business exceeding the hours specified under the licence.

Yu Siong Fung was charged under Section 24 of Entertainm­ent Ordinance 2000, which provides for a fine not exceeding RM20,000 or a jail term not exceeding six months or both on conviction.

Yu committed the offence at 2.50am on Nov 18, 2018 at an entertainm­ent outlet in Pahlawan Road.

According to the licence issued by the local authority, the business hours of the outlet are from noon to 2.30am.
