Housing tribunal settles 14 cases so far this year
KUCHING: The Sarawak Housing Purchaser Claims Tribunal has settled 14 cases brought before it so far this year while for the whole of last year, it settled 103 cases. In 2017, 50 cases were settled by the tribunal.
According to a press release yesterday, the tribunal was established on May 1, 2010 to provide an alternative way to settle housing disputes between housing developer and purchaser.
“The tribunal will hear and adjudicate housing purchaser’s claims for compensation of liquidated ascertained damages, defects of workmanship as well as non-compliance with the specifications stated in the Sale and Purchase Agreement.
“However, the tribunal wishes to remind the public that claims have to be filed no later than 18 months from the issuance date of the Occupation Permit, or before the defects’ liability period ends, as specified in the Sale and Purchase Agreement,” the statement added.
During the hearing, both purchaser and developer shall not be represented by any advocate.
“Any person who fails to comply with an award made by the tribunal is deemed to have committed an offence and upon conviction, is liable to a fine not exceeding RM5,000, imprisonment for a term not exceeding two years, or both.
On a separate matter, the statement added that Dato Maznah Dasmi was reappointed as the tribunal chairperson recently. Also reappointed were Peter Lim Thiam Seng as deputy chairman and Alhadi Ibrahim, Morni Wahie and Robert Elone as members.
They will also serve for the May 1, 2019 to April 30, 2022 term.
