Jobless man charged with four cases of cheating, misappropr­iation of property

MIRI: An unemployed man pleaded not guilty in a Magistrate’s Court here yesterday to four charges of cheating and one charge of misappropr­iation of property belonging to another person.

Alvin Ong Yi Xiang, 28, from Desa Bahagia Vista Perdana Phase 3, Permyjaya here is facing four charges of cheating under Section 420 of the Penal Code.

For each of the offences, the accused can be jailed between one and 10 years and fined and is liable to whipping upon conviction.

In the first cheating charge, Ong is accused of cheating Lily Wong Hie Li, 44, by conning her to believe that he had transferre­d RM1,600 into her account and led the victim to transfer RM800 back into his own account for his family emergency case.

He allegedly committed the offence at 1.15am on February 4 this year at a lot in King’s Park, Jalan Riam here.

For the other three cheating charges, Ong is accused of cheating Mohamad Safri Jamat, 32, by leading him to believe that he was selling a Proton Wira with registrati­on number QMD87xx, when in actual fact the car was not his and conned the victim to hand over cash to him three times, amounting to RM1,500, RM1,00 and RM700 each time.

The offences were allegedly committed at 11pm on Dec 18, 2018 at a food outlet along Jalan Bendahara, as well as 12am on Dec 19, 2018 and 10pm on Jan 12, 2019 in front of a bank at Boulevard Commercial Centre here.

For misappropr­iation of property belonging to another person, Ong was charged under Section 403 of the Penal Code which carries a jail term of six months to five years as well as fine and whipping upon conviction.

According to the charge, the accused had misappropr­iated a property, which was a car with registrati­on number QMT93xx belonging to Lim Sze Jeng, 26, with the purpose of selling it to another person.

Ong allegedly committed the offence on May 19, 2018 behind a tyre shop at Jalan Sri Dagang here.

Earlier, prosecutin­g officer ASP Mary Ong applied for a new date for case management as the accused pleaded not guilty and claimed trial.

Magistrate Kasyfurrah­man Abang Ahmad later set May 16 for case management while the accused was ordered to be freed on RM8,200 bail with two local sureties while awaiting the date.
