Indonesian gets 20 years, four strokes
An Indonesian man was jailed for 20 years and four strokes of the cane a er he pleaded guilty at the Sessions Court here yesterday to two counts of rape and two charges of sexual offences against an underage girl.
Maxi Banfati, 30, was charged under Section 376(1) of the Penal Code for the two counts of rape, which provides for a jail term of up to 20 years, and also be liable to whipping.
The third charge was framed under Section 377CA of the Penal Code for sexual connection by object which carries a minimum five years and maximum 30 years’ jail, and shall also be liable to whipping.
The fourth charge was indicted under Section 14(a) of the Sexual Offences Against Children Act 2017, and punishable under Section 14 of the same Act.
It carries a jail term not exceeding 20 years and shall also be liable to whipping.
Maxi committed the offences on the girl who was 12 years and three months old at various places and times on April 22 and 23, and two times in March.
Judge Caroline Bee Majanil sentenced the accused to nine years’ jail for the first charge and 11 years’ jail plus two strokes of the cane for the second charge. The two sentences are to run consecutively.
For the third charge, he was sentenced to 12 years in prison with one stroke of the cane, and for the fourth charge, 14 years’ jail and one stroke of the cane.
The judge ordered that the two sentences are to run concurrently, and concurrently with the sentences for the first and second charges; a total of 20 years in jail.
Maxi was also sentenced to three months’ jail by the same court a er he pleaded guilty to entering Malaysia illegally.
The charge was framed under Section 6(1)(c) of the Immigration Act 1959/63 (Amendment 2002) and punishable under Section 6(3) of the same Act.
The charge carries a fine not exceeding RM10,000 or a jail term not exceeding five years or both, and shall also be liable to whipping of not more than six strokes.
He was found guilty of the offence at 1pm on April 24 at the central police station here.
