Grandpa fined RM5,000 for possessing drug

MIRI: A grandfathe­r was fined RM5,000 in default nine months’ jail by the Magistrate’s Court here yesterday for possession of the dangerous drug – methamphet­amine.

Magistrate Leona Dominic Mojiliu meted out the sentence on Hii Lu Kah, 57, who pleaded guilty to the charge framed against him.

Hii of Oncidum Road, Luak Bay here, was charged under Section 12 (a) and Section 39A (1) of the Dangerous Drugs Act (DDA) 1952, which provide for an imprisonme­nt term of not less than two years and not more than five years and whipping not less than three times and not more than nine times, upon conviction.

Based on the charge sheet, Hii was not a person authorised under DDA 1952 for possession of 1.58 grams of methamphet­amine – an item listed in Part III First Schedule DDA 1952 (Amended 2001).

He committed the offence at 10.45 am on December 28, 2019 in a room on the third floor of a building at Jalan Melayu, Centre

In court, the accused, who has two grandchild­ren, appealed for lighter sentence as he had financial difficulty, being deprived of income due to the Movement Control Order and had to look after his 86-year-old mother.

ASP Mary Ong prosecuted while the accused was not represente­d.
