Dr M files judicial review over Zulkefli’s appointment
KUALA LUMPUR: Tun Dr Mahathir Mohamad has filed a judicial review application over the appointment of Tan Sri Zulkefli Ahmad Makinudin as additional judge and Court of Appeal president.
Dr Mahathir filed the suit at the High Court registry here yesterday via law firm Messrs Haniff Khatri.
He named Prime Minister Datuk Seri Najib Tun Razak, the Government and Zulkefli as the first, second and third respondents respectively in the legal challenge.
The former prime minister is seeking a mandamus order to compel Najib and the Government to immediately advice the Yang di-Pertuan Agong to revoke Justice Zulkefli’s appointment as additional judge and Court of Appeal president.
The application is also seeking an order under the Rules of Court 2012 to suspend Zulkefli from carrying out any duty in any form as the Court of Appeal president until further orders are issued.
Dr Mahathir said Article 125(1) of the Federal Constitution does not permit those who have reached 66 years of age to hold the Court of Appeal president’s post.
He said Article 122 also does not allow any additional judges of the Federal Court to hold any post in the four highest Federal Court positions, including the post of the Court of Appeal president.
