Court throws out suit against Subra
PUTRAJAYA: A lawsuit against MIC president Datuk Seri Dr S. Subramaniam for alleged conspiracy to topple his predecessor Datuk Seri G. Palanivel in 2015 was thrown out after former party leaders withdrew the case.
Datuk V. Manokaran informed the Federal Court that his client, former MIC strategic director K. Ramalingam, pulled back the lawsuit on Tuesday while two others – Datuk Henry Benedict Asirvatham and Datuk M.V. Rajoo – withdrew last month.
They had sued Dr Subramaniam and seven others including former Registrar of Societies Malaysia (RoS) director-general Datuk Mohammad Razin Abdullah and RoS officer Akmal Yahya.
Though the Kuala Lumpur High Court threw out their case, the Court of Appeal reversed the decision, prompting Dr Subramaniam and the others to challenge the decision.
The Federal Court yesterday ruled in their favour, reinstating the High Court’s decision to strike out the application, and made no order as to cost.
On Feb 5, 2016, Ramalingam and seven others filed the suit to remove Dr Subramaniam from the MIC president’s post.
This followed a series of lawsuits involving Palanivel and the RoS over its directive for MIC to hold re-elections. However, during the MIC presidential re-elections in 2016, Dr Subramaniam won unopposed.
