RM500mil claim thrown out
Matrimonial asset lawsuit by Taib’s former daughter-in-law fails
KUALA LUMPUR: The Syariah High Court has struck out the RM500mil joint matrimonial asset claim filed by Sarawak Governor Tun Abdul Taib Mahmud’s former daughter-in-law Shahnaz A. Majid against her ex-husband.
Syarie judge Mohamed Fouzi Mokhtar made the decision on the grounds that the claim was “incomplete”.
“The case was filed seven years ago but up till today, the application is not complete. Any allegation should be detailed and complete.
“Based on the case law, the court can strike out the claim with liberty to file a fresh application,” he said
after allowing Shahnaz’s former husband Datuk Seri Mahmud Abu Bekir Taib’s objection on the amend- ed joint matrimonial claim yesterday.
Shahnaz’s syarie lawyers Datuk Akberdin Abdul Kader and Dr Mohd Rafie Mohd Shafie later said they would refile a new application before the end of the year.
Previously, Shahnaz had filed a RM300mil matrimonial asset claim other than the RM100mil mutaah claim (conciliatory gift) in 2011.
But she amended the claim from RM300mil to RM500mil.
On Oct 16 this year, the Syariah Appeals Court had upheld the Syariah High Court’s decision, instructing Mahmud to pay the RM30mil in the mutaah claim to Shahnaz.
The court also ordered for the payment to be made in three instalments of RM10mil.
The first payment has to be made before or on Oct 31.
The Syariah High Court had on March 10, 2016, directed Mahmud to pay the RM30mil in mutaah claim to Shahnaz, who is jazz singer Sheila Majid’s elder sister.
Following this, Mahmud filed an appeal.
In March 2016, Shahnaz filed a cross-appeal on grounds that the RM30mil was “insufficient”.
Mahmud and Shahnaz were married on Jan 9, 1992.
The couple divorced on May 11, 2011.
