Indian national jailed 54 months for causing death of co-worker

KUALA LUMPUR: A restaurant worker was sentenced to 54 months in jail by a Sessions Court here for causing the death of a co-worker.

Sessions Court judge Rohatul Akmar Abdullah passed the sentence on N. Arumugan, 45, after he changed his plea to guilty on the first day of the trial here yesterday.

The court ordered for the jail time to run on the date of his arrest on May 12 last year.

Arumugan was accused under Section 304(b) of the Penal Code for culpable homicide not amounting to murder.

The offence carries a maximum 10 years imprisonme­nt or fine or both, upon conviction.

The Indian national committed the offence at a house at Jalan Ismail Ghaney off Jalan Ipoh, Kampung Kasipillay here between 11.30pm on May 10, 2018 and 1am on May 11, 2018.

The victim, Balagurusa­my, was also an Indian national.

Earlier, DPP Kamarul Aris Kamaluddin asked the court to mete out a heavy sentence as it was a serious crime.

Arumugan, who was unrepresen­ted, told the court that he had done so unintentio­nally and asked for a lenient sentence.

According to the statement of facts, Arumugan and the victim went home drunk after a celebratio­n at a temple on May 10 last year.

While at the house, an argument broke out and the two got involved in a fist fight when the victim fell and hit a sharp corner of a table.

Arumugan had then tried to help him. The next day, he tried to wake the victim up to go to work but the man said he was unwell.

Arumugan took him to the hospital where he died of a brain injury.
