Khir, wife withdraw forfeiture review applicatio­n

PUTRAJAYA: Former Selangor mentri besar Dr Mohamad Khir Toyo and his wife’s review applicatio­n for clarificat­ion of a forfeiture order of their property was withdrawn at the Federal Court yesterday.

The five-men panel of judges led by Chief Justice Tan Sri Ma Raus Shariff struck out the applicatio­n, after their lawyer M. Athimulan informed about the withdrawal of the applicatio­n.

“After studying all the affidavits and the judgment, we have advised out client accordingl­y and the instructio­n is to withdraw,” said Athimulan.

Mohamad Khir and his wife Zahrah Kechik had filed the review applicatio­n seeking for clarificat­ion in relation to the court’s order for them to forfeit their two plots of land and a bungalow.

On Sept 29, 2015, Mohamad Khir was ordered to serve 12 months in jail after the Federal Court rejected his final appeal to set aside his conviction for using his position as mentri besar to obtain two plots of land and a bungalow unit in Shah Alam.

The court also upheld that the High Court order for forfeiture of his land was in accordance with the law.

The land of the property was jointly owned by Khir and his wife.

After serving six months in prison, Mohamad Khir was released from prison on March 29, 2016 and was granted parole.

Raus sat together with Chief Judge of Sabah and Sarawak Tan Sri Richard Malanjum, Tan Sri Zaharah Ibrahim, Datuk Balia Yusof and Datuk Prasad Sandosham.
