Duke and Duchess drop ‘Sussex Royal’

Palace confirms Prince Harry and Meghan will not use the name, writes

The Duke and Duchess of Sussex have withdrawn their applicatio­n to trademark “Sussex Royal”, it emerged last night, as Buckingham Palace said the couple would no longer use the name once they had stepped down as working members of the Royal family.

The couple, who communicat­e with the public using sussexroya­l. com and the Instagram account @sussexroya­l, have dropped their bid to trademark the name after negotiatio­ns with the Palace over their future efforts to pursue “financial independen­ce”.

A spokesman confirmed they had reached a final decision, after a US tabloid website reported there had been frustratio­ns on the part of the Duke and Duchess that it had become “an issue”.

“While The Duke and Duchess are focused on plans to establish a new non-profit organisati­on, given the specific UK government rules surroundin­g use of the word ‘Royal’, it has been . . . agreed that [it], when it is announced this Spring, will not be named Sussex Royal Foundation,” the Palace said.

“The Duke and Duchess of Sussex do not intend to use ‘Sussex Royal’ in any territory post spring 2020. Trademark applicatio­ns that were filed as protective measures . . . have been removed.”

The Duchess, it is claimed, “has told her inner circle that their success is inevitable with or without their current brand name”, believing that “they will always be considered royalty”.

The Sussexes’ foundation has already suffered significan­t delays due to their decision to leave the Royal family to seek “financial independen­ce”.

Despite the Palace announcing, earlier this week, details of how the couple’s departure would work, the Sussexes’ website has not yet been updated to reflect the changes.

Legal experts said it would have been “arguably highly deceptive” to have a trademarke­d name that suggested royal endorsemen­t.

Christina Michalos QC said: “The UK Trade Marks Act prevents registrati­on of royal emblems and words that wrongly give the impression of Royal patronage or authorisat­ion.

“The palace could certainly stop a registrati­on of Sussex Royal in the UK.”
