AN inmate in Christchur­ch Men’s Prison received a jail term for an assault on a fellow prisoner in May.

Appearing in the Dunedin District Court by AVL this week, Scott Edward Moseley (37) pleaded guilty to a charge of Crimes Act assault.

The police summary said Moseley and the victim were in a yard at the prison at recreation time, about 1.30pm, on May 22.

A prolonged assault on the victim by another prisoner was closely watched by Moseley.

When that assault ended, the victim managed to get to his feet.

Moseley approached and punched the victim once in the head. He then turned away from the victim and continued walking lengths of the area.

Moseley, who waived his right to a presentenc­e report, was convicted and sentenced to four months’ jail.

A Paul Emmanuel Milligan (51), unemployed, of Dunedin, aggravated driving while disqualifi­ed (three previous such conviction­s since 2007, seen driving with a female passenger, told police he thought the disqualifi­cation had finished; defence counsel Nathan Laws said his client was only days from the end of a 13month ban, now a grandfathe­r), 10.45am, June 21, Factory Rd, 100 hours’ community work (instead of driving ban).

A Lachlan James McCabe (21), employed, disqualifi­ed driving, Forfar St (said just going to visit a friend around the corner), about 1.30am, August 21, 160 hours’ community work (and to undergo driver improvemen­t programme), no driving disqualifi­cation.

A Justin Philip Witchall (26), of Dunedin, careless driving, driving while suspended (Witchall was suspended for excess demerit points on August 7, drove vehicle through Aramoana, exceeded 30kmh limit, drove to the end of a deadend road, turned around, accelerate­d away, swerved right, hit an embankment, vehicle rolled on to its roof, Witchall and his pregnant girlfriend had to climb out of the boot, said he was ‘‘just going for a drive’’), 11.45am, August 27, Moana St, 75 hours’ community work, six months’ disqualifi­cation (starting on November 6).

A Dakia John Henare (23), dangerous driving in Andersons Bay Rd, failing to stop for police, driving while forbidden, about 9.15pm, June 7, overall sentence nine months’ intensive supervisio­n, 90 hours’ community work, disqualifi­ed 12 months.

A Talo Uelese (20), plasterer, of Dunedin, dangerous driving (speed was detected at 168kmh while passing two cars, told police he was not aware of his speed; duty lawyer Louise Garthwaite said Uelese had successful­ly completed residentia­l rehabilita­tion last year, he was returning from the gym when the offending took place), 8.50pm, September 4, Southern motorway, 60 hours’ community work, six months’ disqualifi­cation.

A Christophe­r Brad Jones (39), of Dunedin, careless driving causing injury (reached intersecti­on on Hanover St westbound, victim was riding motorcycle north on Anzac Ave, Jones failed to see him and crossed intersecti­on, hit the bike with front of his Holden, victim was knocked off and then aided by defendant and passersby, suffered three fractures to his pelvis, right knee ‘‘popped out’’ on impact; court heard there had been a positive restorativ­e justice conference and Jones had satisfied the costs incurred by the victim), May 24, 40 hours’ community work (instead of driving ban).

A Geoffrey John Lambourne (65), superannui­tant, of Harwood, assault using piece of wood as weapon (Lambourne and victim live in same area; victim and wife walking their dogs on beach, Lambourne nearby; victim approached Lambourne to discuss language used towards him few days prior, Lambourne appeared intoxicate­d to victim, stood over him in way perceived as threatenin­g; as victim spoke to him, Lambourne took two swings at him, the second connecting with his shoulder, Lambourne kicked out at victim, who grabbed his leg, resulting in Lambourne tumbling to ground, Lambourne got from car boot long piece of wood shaped like baseball bat, swung it at victim, connecting with his left forearm as he was trying to defend himself, victim quickly retreated, received moderate bruising to forearm from assault), April 8, six months’ supervisio­n. Counsel David McCaskill said history of difficulty between the two men.
