Alexandra District Court

-

AN Alexandra man who hurled abuse at police when they were at an accident scene and threatened to ‘‘rip their heads off’’ should get his issues ‘‘sorted’’ before they landed him in prison, Judge Kevin Phillips said in the Alexandra District Court on Tuesday.

Dale McCauley (20), labourer, was convicted of offensive behaviour and resisting police officers acting in the execution of their duty in Alexandra on October 12.

McCauley, who had been drinking heavily, had been walking down Killarney St with an associate when they saw police and emergency services. The emergency services were attending an accident scene.

McCauley launched a ‘‘tirade of abuse’’ at police. He then resisted police, kicking at officers when he was finally handcuffed and subdued.

McCauley had yelled out ‘‘*** the police’’ claiming he was singing the lyrics to a rap song, and said he had not realised police were attending an accident, Judge Phillips said.

Judge Phillips did not accept that, and told McCauley if he had ‘‘difficulties with the police then you need to get them sorted out before it overcomes you and you’re in the bus back to Milburn prison’’.

Counsel for McCauley, Tanya Surrey, said McCauley realised alcohol was a factor and had since cut back on alcohol use.

McCauley was fined $700, court costs $130, and ordered to do 100 hours’ community work and undergo alcohol and drug assessments and programmes. andra, received a new sentence of intensive supervision on a mix of historic and new charges.

Waterman had been sentenced to intensive supervision by Judge Michael Crosbie earlier this year but then breached his conditions. He also faced a new charge of stealing a garlic loaf worth $5 from Alexandra New World, on May 2.

Counsel for Waterman, Russell Checketts, requested a sentence that Waterman ‘‘can deal with and start again with a relatively clean slate’’.

Judge Phillips said Waterman was his own ‘‘worst enemy’’ by repeatedly breaching his conditions.
