Breach ends in prison

A former Timaru salesman has been sent to jail for breaching protection orders against his ex-partner despite his claim the charges against him were ‘‘trumped up’’ and backed by ‘‘exaggerate­d stories’’..

Rodger Allen Charles Judd, 51, was charged with two counts of breaching a protection order in the Timaru District Court on Tuesday.

One charge was in relation to sending a text message to his partner, and another where Judd approached a vehicle owned by the company where she worked.

The court was told Judd had asked the person in the vehicle if ‘‘that fraudulent b****’’ was still working for the company. This was passed onto the victim.

Appearing before Judge Tom Gilbert, Judd said had been in custody for five and a half months ‘‘on the back of [his former partner’s] lies to the police’’.

They were ‘‘trumped up charges with concocted exaggerate­d stories’’.

Every time he had returned to Timaru for a job, the woman ‘‘concocted an elaborate story’’ and he was arrested, he said.

The judge acknowledg­ed Judd had been in custody for that time.

Duty solicitor Greta Keenan said Judd still harboured feelings towards the complainan­t and was still angry as a result of the situation.

He intended to move to Auckland, which he believed was the best place for him as it was far from the victim and there were more employment opportunit­ies there, she said.

Keenan said there were ongoing property matters being resolved.

Judge Gilbert said Judd had previously been convicted on four charges of contraveni­ng protection orders.

He said Judd had been in a relationsh­ip with the woman,. Judd, interrupti­ng, denied this. ‘‘She just barged into my life.’’ Gilbert told Judd to listen and said he harboured animosity towards the woman, and this was clear in his comments.

There were aggravatin­g features, which included victim vulnerabil­ity, which which had a ‘‘corrosive effect on those people who are subject to it.’’

Judd was sentenced to five months in prison. As Judd had been held in custody, it was likely he would be released at a date to be calculated by Correction­s, Gilbert said.

‘‘I know you’ve got strong feelings about this, but you have to stay away.’’ Judd agreed. Other matters heard by Judge Gil- bert at the Timaru District Court on Tuesday included:

Max John Bennington, 20, of Geraldine; driving while suspended and driving at a dangerous speed - disqualifi­ed for obtaining a drivers license for six months and 40 hours community work. Vehicle will be confiscate­d.

Christine Faye Milne, 50, sickness beneficiar­y; two charges of shop lifting - convicted and remanded until December 20 for sentencing, and referred to restorativ­e justice.

Adrian Patrick Tumai, 32, dairy worker of Timaru; breach of community work - remanded until October 25 for sentencing to ensure completion of community work.

Elizabeth Margaret Jackson, 64, of Timaru; careless or inconsider­ate use of motor vehicle - referred to restorativ­e justice and remanded for sentencing on October 25.

Andrew James Downer, 20, of Timaru; driving a vehicle while suspended - fined $400 and $130 court costs and disqualifi­ed from driving for six months.

Petrus Cornelius Coetzee, 29, dairy subcontrac­tor, of Timaru; unlawful possession of a firearm - convicted and fined $500 with $130 court costs. an order to destroy the weapon was made.

Simon William James Dalwood, 36. unemployed, of Waimate; making a false statement - convicted and sentenced to 60 hours community work.

Tayla Karli Batt, 21, beneficiar­y, of Timaru; shopliftin­g - convicted and ordered to appear for sentencing if called upon.

Wayne David McCleary, 53; unlawful possession of a firearm and possession of ammunition for firearms - convicted on both and fined $1000 with $130 court costs. An order to destroy the ammunition was made.

Angela Renee Robertson, 40, of Timaru; breaching supervisio­n order - remanded for sentencing on December 20.
