Recall process: Melaye appeals court judgement

Senator Dino Melaye has approached the Court of Appeal in Abuja seeking to stop the recall process by the Independen­t National Electoral Commission (INEC) for being illegal, wrongful and unconstitu­tional.

A Federal High Court in Abuja presided by Justice Nnamdi Dimgba had on Monday dismissed Melaye’s suit challengin­g the recall process for lack of merit and ordered the electoral umpire to go ahead with the recall after service of the relevant documents to him.

In the appeal, counsel to Melaye (APC, Kogi West), Mike Ozekhome (SAN) asked the appellate court to set aside the high court judgment that permitted INEC to act on a petition by his constituen­ts, seeking his recall from the Senate.

He also prayed the court to grant an ”order of perpetual injunction restrainin­g the 1st defendant/respondent (INEC), whether, by itself, staff, employees, agents, servants and or privies howsoever called, from commencing or further continuing with the process of acting on the purported petition presented to it by the purported constituen­ts of the plaintiff against the plaintiff.”
