Injurious falsehood: Judge’s absence stalls Misau’s trial

Absence of the trial judge yesterday stalled the trial of Senator Isah Hammah Misau (Bauchi, APC) before an FCT High Court.

The case which was adjourned to yesterday on December 5, 2017 at the instance of the court was further adjourned to January 29, when the court did not sit.

While Misau and his legal team as well as the prosecutio­n team were in court yesterday, no reason was however, given for the court’s adjournmen­t of the case.

Misau was arraigned by the Federal Government on a fivecount charge, which included disseminat­ion of falsehood against the Police Service Commission and the Nigerian Police Force, between August and October 2017.

However, on November 28, when the matter last came up, a senior advocate of Nigeria, Dr Alex Izinyon informed the court that he had been given the fiat of the Attorney-General of the Federation (AGF) to take over the matter as prosecutio­n counsel.

Daily Trust reports that Izinyon earlier appeared as the IGP’s lawyer when the latter appeared with him before Senate Adhoc Committee probing the allegation­s levelled against him by Senator Misau.

He said upon taking instructio­n to take over the matter, he filed two applicatio­ns before the court, one of them, he said is seeking the leave of the court to correct some of the five-count charge and add two others.

He said the second applicatio­n sought the leave of the court to set aside the subpoena issued on the IGP to give Misau certain documents in his possession as well as to testify as his (Misau) witness.
