‘Rome was not Built in a Day’

My name is Emmanuel Oche Ochai. I had my primary school at the National Veterinary Research Institute Staff Nursery/Primary School, Vom, Plateau State. I then attended the Boys' Secondary School, Gindiri, Plateau State. Then Benue State University, Makurdi, where I studied Law. I then proceeded to the Nigerian Law School, Lagos Campus, where I obtained my B.L, and was subsequent­ly called to Nigerian Bar on the 13th November, 2007. I am presently pursuing my Masters at the University of Lagos, Akoka and also practice in Lagos as a Partner in the law firm of B. Aguegbodo & Co.

Have you had any challenges in your career as a Lawyer, and if so, what were the main challenges?

Yes, I have had challenges as a Lawyer, one of which is the perception of the public towards Lawyers who take criminal defence cases in Nigeria. Because of the media trial of some of these criminal cases, the Defendants are already pronounced guilty in the court of public opinion, not minding the fact that by virtue of our Constituti­on, these Defendants are presumed innocent until proven guilty. However, as a Lawyer, if you take one of those cases, the public does not see you as a profession­al doing his job, the public does not realise that these persons may be innocent, but rather, you are seen in most cases, as an accessory to the offence. Secondly, our courts in Nigeria are congested, and the spillover effect is having cases last for so long in courts, with incessant adjournmen­ts. We need more courts and more Judges, and Lawyers have to also advice and encourage their clients, to consider Alternativ­e Dispute Resolution like Mediation and Arbitratio­n, which in most cases, is faster than litigation.

What was your worst day as a Lawyer?

My worst day as a Lawyer was years back, when I newly started practice. I was arguing an applicatio­n and I relied heavily on a law. Unknown to me, the law had been repealed. The court drew my attention, to the fact that the law had been repealed. People in court, were all laughing at me. It was really embarrassi­ng.

What was your most memorable experience as a Lawyer?

I have a lot of fond memories in this profession, like the first case I handled from beginning to the end, and judgement was delivered in my favour. But, one that will always stand out for me, happened in my second year in practice. I appeared before the High Court in Lagos, and the matter was for hearing. The counsel on the other side, was a very experience­d and senior Lawyer. I was appearing in the case, for the first time that day. The other counsel noticed my inexperien­ce and naivety, so he decided to take full advantage of the situation. The Judge noticed what was going on, and stylishly hinted to me to take an adjournmen­t so I can be better prepared, which I did. The experience really gave me confidence and faith in the system, and the icing on the cake was that, judgement was delivered in my favour in that case.

Who has been most influentia­l in your life?

My late Mother, has been the most influentia­l person in my life. The reason is that, her life experience­s taught me never to give up, no matter how hard the challenge may seem. She became an orphan at a tender age, grew up with different relatives who never really cared for her. She became a widow at an early age, left with six boys to train and care for, which she did excellentl­y. So anytime the journey gets tough, I remember her life and sacrifices, and I keep pushing.

Why did you become a Lawyer?

Growing up, as a child, I watched a lot of movies and was privileged to read a lot of novels as well. Whenever I came across a character in those books and movies who was a Lawyer, I really admired those characters, especially the ones I saw in those movies. All I wanted, was to be like those Lawyers that I watched and read about. I guess that was a major factor, in my decision to be a Lawyer.

What would your advice be to anyone wanting a career in Law?

Law is a great profession, which puts one in a position of great privilege. And to whom much is given, much is also expected. The beginning may seem rough and tough, but they should always remember that, ‘Rome was not built in a day'. Therefore, to get to the very top of the profession, requires a lot of sacrifice, hard work, dedication and patience. Success in the profession, does not come over night. However, when the right indices are in place, success is guaranteed. It doesn't matter if there are millions of Lawyers out there, the sky is wide enough to contain both the eagle and the pigeon.

If you had not become a Lawyer, what career would you have chosen?

If I had not become a Lawyer, I would probably have been a Pilot.

Where do you see yourself in ten years?

In ten years' time, I see myself as a Senior Advocate of Nigeria, managing and piloting the affairs of one of the top five Law Firms in Nigeria.
