Now juveniles can work part-time

Dr Mahad bin Said bin Ali Baowain, Minister of Labour, issued a Ministeria­l Resolution 115/2021 regarding part-time employment for juveniles. The decision said an employer might hire general diploma or higher education students under the partial work system, on par with job seekers and retirees.

“It is required when employing general diploma students in the part-time work system that the candidate is an Omani, enrolled in public or private schools, and not less than 15 years of age,” said the decision.

The employment can take place only during breaks after semester exams with approval from parents. The decision states that both parties will determine the wages and the working hours of the employees through a contract.

The ministry also stipulated that work should be in the jobs specified by the Ministeria­l Resolution 217/2016, which are: Salesperso­n of books, clothes, foodstuff, shoes, bags, tailoring materials, household utensils, electrical appliances, gifts and antiques, jewellery, watches, sports clothing, scientific equipment, carpentry tools, industrial machines, bicycles, and others.

The decision is based on the Labour Law issued by Royal Decree 35/2003, and Royal Decree 89/2020, establishi­ng the Ministry of Labor and determinin­g its terms of reference and the adoption of its organizati­onal structure, and to Ministeria­l Resolution 217/2016 regarding the system of employment of juveniles and the businesses and profession­s in which they may be employed, and to Ministeria­l Resolution 40/2017 regarding the organizati­on of part-time work, and based on what is required by the public interest.

Article 2 states that the decision 40/2017 is repealed, and everything that contradict­s this decision or contravene­s its provisions.

Decision 40/2017 stated that a part-time Omani worker may be employed where his daily working hours should not exceed four hours and should not exceed 25 hours a week. The part-time work is limited for Omanis and at a minimum hourly wage of RO 3. It allows those aged 15 to 18 to work parttime. The work hours should be from 6 am to 6 pm.
