Money trail leads to home of Amin Fahim home: SC

Chief Jus­tice of Pak­istan (CJP) Iftikhar Chaudhry has re­marked money trail leads to home of Amin Fahim and then what is left more.

CJP gave th­ese re­marks while pre­sid­ing over a 3-mem­ber bench of SC dur­ing the course of hear­ing of NICL Scan­dal case here Tues­day.

Com­merce sec­re­tary, Munir Paracha, coun­sel for FIA, SM Za­far coun­sel for com­merce min­is­ter Makhdoom Amin Fahim and other se­nior of­fi­cers ap­peared be­fore the court.

The court was told that Amin Fahim had ap­pointed Ayyaz Ni­azi. Four ac­cused are out­side the coun­try and ac­tion is be­ing ini­ti­ated against them. Most of the ac­cused in­clud­ing Amin Fahim who are present in Pak­istan have been re­leased on bail. Fi­nan­cial loss to the tune of Rs 2.6 bil­lion has been caused to na­tional ex­che­quer in NICL scam and a sum of Rs 1.20 bil­lion have been re­cov­ered. The amount which was trans­ferred to Amin Fahim ac­count, has now been trans­ferred to re­spec­tive ac­counts from where it was trans­ferred. CJP re­marked Ayyaz Ni­azi was ap­pointed un­der the di­rec­tives of Amin Fahim and trans­fer of money av­enue leads to the home of Amin Fahim. Then what is left more, he in­quired.

The court asked com­merce sec­re­tary it was his re­spon­si­bil­ity to take ac­tion against the ac­cused. “You have reg­is­tered cases against them. Now pro­vide the ev­i­dence against them too and if your ev­i­dences are proved false then ac­tion will be taken against you. When court starts hear­ing of any case then the government in­sti­tu­tions be­come ac­tive and be­fore it, all of theme are ly­ing in a state of slum­ber. Go and ini­ti­ate pro­ceed­ings against the ac­cused per­sons. Reg­is­ter the cases against whom the cases have not been reg­is­tered. FIA has done noth­ing against the ac­cused sit­ting abroad ex­cept reg­is­tra­tion of cases against them. Un­der FIA rules if the ac­cused sit­ting in Pak­istan are not ap­pre­hended then how those sit­ting abroad will be ar­rested.

Di­rec­tor La­hore Waqar Haider ap­peared be­fore the court when the court sought report on the mat­ter of La­hore land.

CJP ex­pressed his an­noy­ance when he saw Waqar Haider re­mark­ing “con­tempt of court case is pend­ing hear­ing in our court against you and you are ap­pear­ing here. How can you ap­pear. What hap­pened about your case. Waqar Haider told the court his case is ly­ing in the bench led by Jawad S Khawaja and it has not been fixed for hear­ing since the last two months. Case is still run­ning.

CJP re­marked “what re­spect has been paid to the or­ders of the court that the per­son against whom SC has ini­ti­ated con­tempt of court pro­ceed­ings is en­joy­ing di­rec­tor­ship. Court has been made laugh­ing stock. What or­der is given is not im­ple­mented. What FIA wants? First of all we will see the mat­ter of Waqar Haider and then we will see the other things. FIA should present de­tailed report on the en­tire case and its ex­pla­na­tion with ref­er­ence to Waqar Haider in the court. What­ever or­der is given to the government, ac­tiv­ity starts con­trary to the or­der. Op­po­nent of court be­comes pi­ous and vir­tu­ous per­son.
