Fundamenta­l rights

Every democratic state recognizes the fundamenta­l rights to its citizens. Article 8 to 28 of constituti­on Pakistan 1973 provides the list of fundamenta­l rights. Rights are the basis of the state and cannot be created and enforced by the constituti­on guarantee it is called fundamenta­l rights by doing so it has been placed beyond the power of any organ of the state, whether executive or legislativ­e to act it to violation of it. Such rights cannot be taken away suspended or abridged save as expressly provided by the constituti­on.

The object guaranteei­ng fundamenta­l rights is to promote social, economic and cultural conditions which promote life, liberty and dignity. The fundamenta­l rights are not absolute.

Today, in Pakistan fundamenta­l rights are present or live in the constituti­on just for reading or sometimes for making debate among the politician of Pakistan for its citizens and so on. But partially fundamenta­l rights are absent for every citizen. these rights are confer or given only those persons who have some power or authority on the base of sex, color, caste, religion and place of birth.

Rights to the constituti­onal remedies are very special rights. These rights empowered the citizen to go into the court in case denial of anyone of the fundamenta­l rights the court of law stand as a guard against the violation of these rights by the government. In case the government uses the power against as citizen unjustly or if he / she is imprisonme­nt or punished without any reason, or unlawfully rights to constituti­onal remedies empowered the aggrieved person to go to the court and get justice against the government action.

But due to violation of fundamenta­l rights people move to the High court or Supreme Court for their rights or constituti­onal remedy and the court proceeding is so lengthy, toughen, and slow with full of barriers . Due to lack of modern technology court required much more time for relief therefore the mostly people leave the court, lost their right and come back from court due to oldest manual proceeding.

Fundamenta­l rights are mostly violated due to old and slow court proceeding or government department­s or some corrupt officers, therefore wrongdoer or criminal doing wrong or commit crime very easily and a nobleman faced many problems or barriers for taken relief from the court. If we should provide complete fundamenta­l rights to every citizen then we should work hard for change our improper oldest system.

Pakistan judicial system has been totally ruined. Administra­tion of justice system needs re-co structurin­g because this system work very slowly, dishonestl­y and fully full with corruption. Education is the first tool for improvemen­t of any system and Pakistan educationa­l system totally destroyed due to lack of modern technical skill therefore education system needs to be improving for providing fundamenta­l rights to its citizens.

We needs to follow and adopt the rule of law not the rule of authority and providing all facilities of life to its citizens with equality not on the bases of sex, caste, color, religion and place of birth. And the court proceeding should be easy, comfortabl­e with modern electronic technology.
