Awtoridad ng Ombudsman balak kuwestiyunin sa SC

Plano ng Malacañang na kuwestiyunin ang awtoridad ng Office of the Ombudsman na imbestigahan ang isang impeachable official para makapaghain ng impeachment complaint.

Ito ay kaugnay ng pagsisiyasat ng Office of the Ombudsman sa sinasabing tagong yaman ni Pangulong Rodrigo Duterte na umaabot sa P1 bilyon.

Sa press briefing kahapon, sinabi ni Chief Presidential Legal Counsel Salvador Panelo na pinag-aaralan nila ang probisyon sa Ombudsman Act of 1989 na para sa kanya ay labag sa batas.

“My theory now is that the Ombudsman investigation currently of the President is unconstitutional even if there is a provision in the Ombdusman’s law that it has investigatory power,” sabi ni Panelo. “To my mind, it will circumvent the doctrine of immunity of a sitting president from suits.”

Ayon kay Panelo, ang mga bagay na iniimbestigahan ng Ombudsman na umano’y ginawa ni Duterte ay nangyari noong alkalde pa ito ng Davao City.

“[The acts] cannot be the subject of an investigation for purposes of filing an impeachment complaint, assuming that it has the power to do so, which to my mind it doesn’t have, even if there is a law,” ani Panelo.

Dagdag ni Panelo, kakausapin niya si Solicitor General Jose Calida at sakaling magkasundo sila ay ikokonsidera nilang pormal na kuwestiyunin sa Korte Suprema ang investigatory power ng Ombudsman—ngunit ito ay kung papayag si Duterte.

Una nang sinabi ni Pangulong Duterte na hindi siya makikipagtulungan sa imbestigasyon ng Ombudsman laban sa kanya dahil ang hawak nitong ebidensiya ay “fabricated” at “illegally obtained”. Pinangunahan ng Tindig Pilipinas, The Silent No More Organization, Magdalo, Prayer Battalion for Truth and Justice at iba pa ang misa para kay Morales ilang araw makaraang hamunin ni Pangulong Duterte ang huli na magbitiw sa puwesto kasabay niya.

Nanguna sa misa si Fr. Robert Reyes, at dumalo ang mga personalidad na nauugnay sa dating administrasyong Aquino, gaya nina dating Department of Social Welfare and Development Secretary Dinky Soliman, dating Department of Education Secretary Bro. Armin Luistro, Magdalo Rep. Gary Alejano, at dating Commission on Human Rights Chairperson Etta Rosales.

‘IRONY’ Samantala, ipinagtataka naman ni Senator Panfilo Lacson ang pagbuo ni Duterte ng Presidential AntiCorruption Commission, na ayon sa kanya ay kailangang-kailangan ng Office of the Ombudsman.

“It’s an irony that while the President may want a body to check on the Ombudsman, he created one that the Ombudsman needs exactly. It’s interesting to watch how this new partnership plays out,” sabi ni Lacson.

“I’m not sure if it’s an irony that it is actually what the Ombudsman needs at present—a law enforcement arm that can develop cases, conduct entrapment operations, apply for search warrants and perform other related law enforcement functions,” dagdag ng senador.
