Digong magpo-prosecutor vs Sereno?

Nais ng abogadong si Lorenzo Gadon, ang nag- iisang complainant sa impeachment case laban kay Supreme Court Chief Justice Maria Lourdes Sereno, na tumulong si Pangulong Rodrigo Duterte sa paglilitis sa Punong Mahistrado.

Sa isang news forum sa Quezon City, sinabi ni Gadon na maaaring matupad ang hiling ni Duterte na patalsikin si Sereno sa pagsali sa grupo ng “private” attorneys na bubuohin ng House of Representatives upang patalsikin si Sereno.

“I will file a motion before the Committee on Justice to name President Duterte among the private prosecutors who will participate in convincing Senate that the chief justice should be removed,” pahayag ni Gadon, tinutukoy na sinimulan ng chief executive ang kanyang career bilang isang private practitioner at nangungunang government prosecutor.

“Sana payagan maging special prosecutor si Presidente, wala naman batas nagsasabing hindi ito p’wede. I will formally file a motion with the HOR and the Senate to allow him to help prosecute CJ Sereno,” ani Gadon.

Gayunman, inamin niya na hindi pa niya inaalok kay Duterte ang nasabing gampanin, sinabing hindi siya kilala ng chief executive.

Samantala, tinutulan naman ni Deputy Speaker Fred Castro, gayundin nina Reps. Bernadettte Herrera- Dy ( Bagong Henerasyon Partylist) at Prospero Pichay Jr. ( PDP- Laban, Surigao del Norte) ang ideya.

Ayon kay Castro, dating law professor, sa pagre- recruit ng Mababang Kapulungan ng private prosecutors, inaasahang susuportahan nito ang constitutional principles ng separation of powers at ng check and balance.

Sa ilalim ng 1987 Constitution, tanging Mababang Kapulungan lang ang responsibilidad na maghain at mag-prosecute ng impeachment issues laban sa pinuno ng constitutional bodies, SC chief justice at maging sa pangulo.

“I am afraid that we cannot appoint anyone coming from the executive unless we amend the Constitution to allow this,” sabi ni Castro.
