TRO sa contraceptives, wala nang bisa –DoH

sa kumpirmasyon ng Food and Drug Administration (FDA) na non-abortifacient ang 51 contraceptives, itinuturing ng Department of Health (DoH) na wala nang bisa ang temporary restraining order (TRO) ng Korte Suprema sa subdermal implants, Implanon at Implanon NXT, sinaibi ng isang opisyal.

“With the advisory of the FDA, the TRO is already deemed lifted,” lahad ni Undersecretary for Health Regulation, Dr. Mario C. Villaverde, sa panayam ng media nitong Martes.

Inihayag ni Villaverde na dahil sa resulta, ang mga gumagawa ng mga produktong ito na pumaso ang certificates of product registration ( CPRs) dahil sa TRO ay maaari nang mag-reapply.

Bilang tugon sa kasong inihain ng Alliance for the Family Foundation Philippines Inc. (ALFI), nag-isyu ang Korte Suprema noong Hunyo 2015 ng TRO laban sa Implanon at Implanon NXT, at kailangan madetermina muna ng FDA kung ang mga ito ay maaaring maging sanhi ng aborsiyon o hindi.

Sinunod ng FDA ang kautusan at nagsagawa ng pagdinig kasama ang manufacturers ng mga contraceptive at mga pro-life advocate, upang magbigay ng impormasyon ang bawat panig at magpaliwanag at magpresinta ng ebidensya sa mga produkto.

Nitong Nobyermbre 10, nagisyu ang FDA ng resolusyon na nagdedeklara sa 51 contraceptive na ligtas at hindi nagdudulot ng aborsiyon.

Sa resolusyon ng Korte Suprema, noong Abril 26, 2017, nakasaad dito, “After compliance with due process and upon promulgation of the decision of the Food and Drug Administration, the Temporary Restraining Order would be deemed lifted if the questioned drugs and devices are found not abortifacients.”

Inihayag din dito na matapos ang pinal na resolusyon ng FDA, “any appeal should be to the Office of the President pursuant to Section 9 of EO No. 247”.

Samantala, inilahad ng pangulo ng Responsible Parenthood and Reproductive Health ( RPRH) implementation team na si dating health secretary Esperanza Cabral na dahil sa resolusyon ng FDA, irerekomenda ng grupo sa DoH na ilabas ang mga implant na hindi pinahintulutang ipamigay sa loob ng mahigit dalawang taon hangga’t epektibo ang TRO.

“This is so they could be used by women who need them,” aniya.

Kabilang sa 51 contraceptives ang pills, injectables at intrauterine devices ( IUDs), bukod pa sa subdermal implants.
