Sereno lawyers bawal mag-cross examine

Tinanggihan ng House Committee on Justice kahapon ang mosyon ni Supreme Court Chief Justice Ma. Lourdes Sereno na ma-cross examine ang mga saksi laban sa kanya sa pamamagitan ng kanyang mga abogado.

Sa botong 30 pabor at apat na kontra, inaprubahan ng House panel sa pamumuno ni Oriental Mindoro Rep. Reynaldo Umali ang mosyon ni AKO BICOL partylist Rep. Alfredo Garbin na tanggihan ang mosyon ni Sereno na naggigiit sa kanyang right to counsel at right to cross examine.

Ang mosyon ay sinegundahan ni Majority Leader at Ilocos Norte Rep. Rodolfo Fariñas, ngunit ibinasura ni Siquijor Rep. Rav Rocamora, isang dating prosecutor.

“We wish to inform the lawyers, and members of this committee that we are not sitting here as an impeachment court...I move that their motion to cross examine the witnesses be denied,” ani Garbin.

“If we allow the lawyers to cross examine the witnesses, we will not be able to bring this to the impeachment court,” idiniin ni Fariñas.

Sa kanyang panig, sinabi ni Umali na, “We are not depriving Sereno of her right to counsel, but their participation is a different matter.”

NgunitayonkayRocamora, dapatpahintulutan ang mga abogado ng CJ, sa pamumuno ni Atty. Alexander Poblador na ma-cross examine ang mga saksi.

“If we’re really interested in expediting these proceedings, in my experience as a public prosecutor, I allow the lawyers to ask directly, why can’t we do this?” aniya.

Bukod kay Rocamora, kumontra rin sa mosyon ni Garbin sina Dinagat Islands Rep. Kaka Bag-ao, Quezon City Rep. Kit Belmonte at Agusan del Norte Rep. Lawrence Fortun.

Pinayagan naman ng House panel ang mosyon “to invite all members of the SC” sa pagdinig sa impeachment case ni Sereno.

Bumoto rin ang House panel na huwag pahintulutan ang mga hindi miyembro ng House Committee on Justice na makilahok sa impeachment proceedings.

FIGHT UNTIL THE END

Matapos ibasura ng House Committee on Justice ang kanilang motion to cross examine, sinabi ng mga abogado ni Sereno na “looking forward” sila na matalakay ang impeachment case sa Senate Impeachment Court na inaasahan nilang magiging patas.

“The decision to expedite would really be the committee’s so we are hoping that they would in fact expedite the process…I am looking forward to that (Senate trial). I will examine (Larry) Gadon and all the witnesses,” ani Poblador.

Idiniin ni Poblador na hindi bibitawan ni Sereno ang puwesto bilang ika-24 na punong mahistrado ng bansa. “No, not at all. She will fight until the end,” aniya.

Tinawag naman ni Atty. Josa Deinla, tagapagsalita ni Sereno, ang pagbasura sa kanilang mosyon na malungkot na araw para sa katarungan.

“This is a sad day for justice in this country that the Chief Justice, who has fought steadfastly to uphold the Constitution and the right of the citizens, has now been denied her own constitutional rights,” ani Deinla.

RULES ON CONFIDENTIALITY

Samantala, inakusahan ng kampo ni Sereno si Senior Justice Teresita De Castro ng paglabag sa SC internal rules on confidentiality of sessions at internal documents.

Sa inilabas na press statement ni Deinla, pinansin ng kampo ng CJ na itinuturo ng impeachment complainant ni Larry Gadon si De Castro bilang source of information ng SC Internal Memorandum na iprinisinta bilang ebidensiya sa impeachment hearings.

“Atty. Gadon’s disclosure that his source of information for Supreme Court Internal Memorandum is no other than Senior Justice Teresita De Castro, if indeed true, reveals that Senior Justice De Castro clearly violated the Internal Rules of the Supreme Court,” ani Deinla.
