Sereno, pinakokomento sa quo warranto petition
Nagpasya ang Supreme Court (SC) kahapon na obligahin si Chief Justice Maria Lourdes P. A. Sereno, nasa indefinite leave simula Marso 1, na magkomento sa quo warranto petition na naglalayong patalsikin siya sa puwesto bilang pinuno ng hudikatura.
Ang pagpapatalsik kay Sereno sa pagpapawalang-bisa sa kanyang appointment ay hiniling sa petisyon na inihain ni Solicitor General Jose C. Calida batay sa letter-complaint na ipinadala ng kanyang opisina.
Matapos ang full court session sa pamumuno ni Acting Chief Justice Antonio T. Carpio, sinabi ng SC na “the Court, without giving due course to the Petition, required respondent Chief Justice Sereno to submit her COMMENT on the Petition (for Quo Warranto) within a period of ten (10) days from receipt of notice.”
Sa press briefing, sinabi ni SC Spokesman Theodore O. Te na tanging si Justice Marvic Mario Victor F. Leonen ang kumontra sa desisyon na dapat maghain ng kanyang komento si Sereno.
Ayon kay Te, iginiit ni Leonen na ang petisyon ni Calida ay dapat nang kaagad ibasura. Hindi nagbigay ng paliwanag si Leonen sa kanyang opinyon.
Nauna rito ay sinabi ng abogado ni Sereno na dapat ibasura ang quo warranto petition ni Calida dahil malinaw na nakasaad sa 1987 Constitution na matatanggal lamang ang punong mahistrado sa pamamagitan ng impeachment.
Iginiit ng kampo ni Sereno na ang huling hakbang ng abogado ng pamahalaan ay maituturing na pangha-harass at pamamahiya sa punong mahistrado para mapilitan itong mag-resign. Ginagawa rin ng mga kritiko ni Sereno ang lahat ng paraan para matanggal ito sa puwesto dahil ang siguradong hindi lulusot ang impeachment complaint sa Senado.
SENADO NABABASTOS
Itinuturing ni Senador Risa Hontiveros na pambabastos at pagbabalewala sa Senado ang pagsampa ni Calida ng quo warranto petition laban laban kay Sereno sa SC.
“It is part of a greater scheme to render the Senate obsolete and irrelevant, when it is one of the few institutions left where the government’s abuses can still be checked. Just imagine, if the Executive can impeach a Supreme Court Chief Justice without the Senate, it can also change the Constitution without it. It is no secret that this government is adamant in changing the constitution even without the participation of the Senate,” ani Hontiveros.
Ayon pa kay Hontiveros, mistula ring kinuwestiyon ng Ehekutibo, sa pamamagitan ni Calida, ang kakayahan ng Senado.
“Wala bang tiwala ang Ehekutibo na kayang magsagawa ng Senado ng maayos na impeachment proceedings? O baka naman tingin nila ay hindi aayon ang resulta ng impeachment proceedings sa gusto nila?,” ani Hontiveros.
GUSTO LANG ALISIN
Dahil mahina ang mga rason para sa impeachment ni Sereno, sinabi ng isang obispong Katoliko na ginagawa ng mga kalaban nito ang lahat ng paraan para mapaalis siya puwesto.
“It seems they want to get rid of her by any means because the reasons for her impeachment are not strong enough,” ani Sorsogon Bishop Arturo Bastes sa isang panayam, bilang reaksiyon sa hakbang ni Calida.
Sinabi naman ni Balanga Bishop Ruperto Santos na ang nangyayari ngayon sa hudikatura ay resulta ng naunang impeachment kay dating CJ Renato Corona.
“What we have in the judiciary is cost and consequences of the impeachment of former CJ Corona. The three branches are independent and must be free from each other. But this independence of judiciary was violated, desecrated before,” aniya.
“History repeats itself,” sabi pa ni Santos.
