Judicial independence ‘di nilalabag ni Duterte

Hindi paglabag sa kalayaan ng hudikatura ang komento ni Pangulong Rodrigo Duterte laban kay Chief Justice Maria Lourdes Sereno.

Ito ang iginiit ni Chief Presidential Legal Counsel Salvador Panelo kasunod ng mga ulat na ilang grupo ng mga abogado ang humikayat sa United Nations (UN) na imbestigahan ang mga pagsisikap na patalsikin ang Chief Justice.

Ayon sa mga abogado, sa pamumuno ng Integrated Bar of the Philippines (IBP), nilalabag ng Executive branch ang judicial independence, sa mga banat ni Duterte laban kay Sereno nitong nakaraang linggo.

Kinontra rin nila ang mga pagsisikap na patalsikin ang Chief Justice sa pamamagitan ng impeachment at quo warranto proceedings sa Congress at Supreme Court, ayon sa pagkakasunod.

Ayon kay Panelo, reaksiyon lamang ito ni Duterte sa mga komento ng Chief Justice na may kinalaman ang Pangulo sa pagsisikap na patalsikin siya.

“The statements of the President against Chief Justice Sereno are not an affront to judicial independence. They were simply reactions to Chief Justice Sereno’s voiced attacks against him,” aniya.

Ayon kay Panelo, kung mayroon mang lumabag sa kalayaan ng co-equal branch, ito ay walang iba kundi si Sereno.

“It is Chief Justice Sereno who has infringed and continues to infringe upon executive independence by resorting to the media and taking advantage of her position as head of one of the branches of the government in expressing her dismay against this Administration on account of the situation in which she put herself into,” aniya.

Ipinaliwanag ng opisyal ng Palasyo na ang impeachment proceedings laban kay Sereno ay ibinatay sa legal grounds at hindi political attack sa pamumuno ni Duterte para patalsikin sa puwesto si Sereno.

“The President did not initiate the impeachment proceedings against Chief Justice Sereno, nor did he play any part in the same,” punto ni Panelo.

Tinawag ni Panelo ang ulat na inihain ng mga abogado sa UN na isa na namang pagsisikap para pagmukhaing masama ang Pangulo sa pandaigdigang komunidad.

“The 16-page report filed by several groups before the United Nations is part of the effort to discredit the President before the international community,” aniya.
