Ex-Quezon mayor kulong sa estafa

Kinasuhan ng Sandiganbayan Second Division ng estafa si dating Sampaloc Mayor Samson Bala Delgado ng Quezon Province dahil sa maling paggamit ng P250,000 loan na ipinagkaloob ng Seaway Lending Corporation.

Hinatulan ng isang buwan at isang araw na arresto mayor si Delgado at isang taon at walong buwan na pagkakakulong matapos mapatunayang guilty sa paglabag sa Article 315 ng Revised Penal Code.

Pinababalik din sa kanya ang P250,000 sa Seaway Lending Corporation.

Noong Nobyembre 1998, natanggap ni Delgado ang nasabing halaga sa bisa ng Sangguniang Bayan Resolution 98-31. Utang na gagamitin sana sa housing project ng munisipyo.

Ngunit ayon sa hatol, delgado "converted the said amount to his own personal use and benefit."

Nagawang ipresenta ng prosekusyon ang testimonial evidence na nagpapatunay na ibinigay ng Seaway ang loan noong Oktubre 1998 at si Delgado ang tumanggap nito.

"With the prosecution having thus hurdled its primordial duty of establishing the elements of the felony, the court is left with no other verdict than conviction," ayon sa desisyon ng korte.

"To belabor the point, when the check was placed in the custody of the mayor, it created as between him and Seaway Lending a fiduciary relationship that obliged him to deliver the amount, represented by the check, to the municipality in whose behalf and under whose authority he was only acting," ayon pa sa desisyon.
