UST law dean ‘di kakasuhan sa hazing slay

Ipinagtibay ng Department of Justice (DoJ) ang desisyon nito na hindi isama si University of Sto. Tomas (UST) civil law dean Nilo Divina at iba pa sa pagdidiin sa mga sangkot sa pagpatay sa hazing victim na si Horacio Tomas “Atio” Castillo III.

Kinumpirma ni Justice Secretary Menardo Guevarra na nag-isyu ang DoJ ng resolusyon na tumutuligsa sa petition for review na inihain ng magulang ni Atio, sina Horacio, Jr. at Carminia, nitong Abril 19.

“It was dismissed for late filing,” ani Guevarra.

Naghain ang magulang ni Atio ng petition review bilang tugon sa March 6 ruling ng DoJ, na nag-aatas ng paghahain ng kasong kriminal laban sa 11 miyembro ng Aegis Juris fraternity ngunit hindi kabilang ang 24 iba pa, kabilang si Divina at iba pa mga miyembro ng Aegis Juris fraternity, dahil umano sa kakulangan sa probable cause at sapat na ebidensiya.

Sa resolusyon na may petsang Hulyo 5 hinggil sa petition for review ng mga Castillo, ipinaliwanag ng DoJ na ito ay “constrained to dismiss Appelants’ Petition by reason that their appeal was clearly out of time.”

“Settled is the rule that the right to appeal may be exercised only in the manner and in accordance with the provisions of the law or pertinent rules of procedure. The party who seeks to avail of the same must comply with the requirements of the law or rules. Failing to do so, his appeal will be dismissed,” nakasaad sa resolusyon na nilagdaan ni dating Justice Undersecretary at ngayon ay Commission on Elections (Comelec) Commissioner Antonio Kho.

“Accordingly, the instant Petition should be denied due course for failure to comply with the requirements on appeal,” diin niya.
