Batangas mayor, binigyan ng TRO

Nagpalabas ng temporary restraining order (TRO) ang Court of Appeals (CA) para sa suspension order na inilabas ng Office of the Ombudsman laban kay Lipa City, Batangas Mayor Meynardo Sabili at sa isa pa nitong opisyal.

Ang nasabing TRO ay inilabas ng CA nitong Huwebes, at ito ay pumipigil sa implementasyon ng isang taong suspension order na nauna nang ibinaba ng Ombudsman laban kay Sabili at sa city administrator nito na si Atty. Leo Latido.

"It appearing, after a careful review of the petition and the comment filed by respondent, that there is urgency for the issuance of a temporary restraining order so as to avoid grave and irreparable injury not only to petitioners themselves but also to the service they represent during the pendency of the petition for review, as well as to prevent the judgement that maybe promulgated from being rendered ineffectual, the court resolves to grant the prayer for the issuance of a temporary restraining order" ayon sa ruling ng CA.

Pirmado nina Associate Justices Franchito Diamante, Associate Justices Edwin Sorongon at Maria Elisa Sempio Diy ang nabanggit na ruling ng CA.

Matatandaang naghain ng petisyon sa korte ang alkalde nitong Hulyo 20, kung saan hinihiling na magpalabas ng TRO ang hukuman kontra sa naturang suspensiyon.

Nauna nang idinahilan ng Ombudsman na guilty sina Sabili at Latido sa kasong administratibo (Oppression and Conduct Prejudicial to the Best Interest of the Service).

Ito ay nag-ugat sa reklamo ni City Social Welfare and Development Officer Teresita Pesa noong Setyembre 2015, kaugnay ng umano’y ipinatupad ng dalawa na illegal reassignments nito.

Ngunit, matapos ang halos dalawang taon ay nagsumite ng apela si Pesa sa Ombudsman at hiniling na ibasura na ang kaso nito na resulta lamang umano ng "hindi nila pagkakaunawaan ng alkalde."
