Hirit ni VP sa 25% ballot shading, aprub

Nagpasya ang Supreme Court, umaaktong Presidential Electoral Tribunal (PET), pabor kay Vice President Leni Robredo na pagtibayin ang 25percent ballot shading threshold para sa nagpapatuloy na recount sa vice presidential electoral protest.

Binago ng PET, sa 21-pahinang resolusyon na may petsang Setyembre 18, ang rules nito sa threshold percentage sa pagsasantabi sa paggamit sa 50 percent threshold sa revision proceedings.

“From the foregoing, for purposes of the 2016 elections, the 50 percent shading threshold was no longer applied. It is likewise clear, however, that a new threshold had been applied,” ayon sa PET.

Sinuportahan ng tribunal ang posisyon ng Commission on Elections (Comelec) na “a range of 20 to 25 percent shading threshold was adopted for the 2016 elections.”

“After assiduously going through the parties’ comments and arguments, the Court herein resolves to partially grant the subject motion insofar as setting aside the use of 50 percent threshold in the revision proceedings is concerned,” saad sa resolusyon.

Ipinaliwanag din ng PET na noong una ay ginamit nito ang 50 percent threshold sa recount dahil “the tribunal was never informed of any official act of Comelec setting the shading threshold at 25 percent of the oval space.”

Isinusulong ni Robredo ang 25 percent threshold sa pagbibilang ng mga boto dahil ito ang ginamit ng Comelec sa halalan 2016.

Muling binibilang ng PET ang mga balota mula sa tatlong lalawigan – ang Camarines Sur, Iloilo, at Negros Oriental – na tinukoy ni dating senador Ferdinand Marcos Jr, na naghain ng electoral protest laban sa kanya.

Pinuri ni Robredo ang desisyon ng SC, isinulat ni Justice Alfredo Alfredo Benjamin S. Caguioa at sinang-ayunan ni Chief Justice Teresita De Castro at iba pang justices maliban kina Antonio Carpio at Diosdado Peralta na nasa official leave.

“Sa akin, walang duda na appreciated ng justices iyong kung ano iyong tama,” ani Robredo sa press briefing.

“And ang hope lang namin, na after the resolution, sana tuloy-tuloy na. Sana mapabilis na. Sana matapos na para makamove on na talaga dito,” dugtong ng Vice President.
