Absuwelto kay Yu, binira ng PDEA

Binatikos ng Philippine Drug Enforcement Agency (PDEA) ang desisyon ng Manila court sa pagabsuwelto kay Dianne Uy Yu, anak ng drug trafficker na si Yu Yuk Lai, at ang akusasyon nito na “itinanim” ng ahensiya ang ebidensiya sa kasagsagan ng operasyon.

Sa pahayag ni PDEA Director General Aaron Aquino, sinabi niya na ang ahensiya ay “strongly disagrees with the decision and condemns the same,” dahil wala itong makatotohanan at matibay na basehan.

Ito ang ipinahayag ni Aquino isang araw matapos magdesisyon ang Regional Trial Court of Manila, Branch 49, na nilagdaan ni Presiding Judge Daniel Villanueva, na nagpapalaya kay Yu.

Base sa desisyon, inabsuwelto si Yu dahil umano sa kakulangan sa probable cause sa pag-iisyu ng search warrant laban kay Yu at umano’y iregularidad sa serbisyo ng mga tauhan ng PDEA.

“Based on the perusal of PDEA, the Decision is more like a pleading arguing in favor of the accused rather than a ruling that resulted from a fair, impartial, and careful trial and deliberation,” ani Aquino, at sinabing ang desisyon ay “absurd.”

Binatikos din ni Aquino ang konklusiyon ni Judge Villanueva na ang droga na natagpuan sa unit ni Yu ay “itinanim” at nanghingi ang mga PDEA agents ng P500,000 bilang suhol.

“PDEA never planted drugs or evidence against anyone. It is never a practice in the Agency,” diin ni Aquino.

Ipinaliwanag ng PDEA chief na ang operasyon na nagresulta sa pagkakaaresto kay Yu ay dahil sa “valid and carefullly thought and planned casing and surveillance operations” ng PDEA agents na tinutuligsa ni Judge Villanueva.

Idinagdag ni Aquino na ang desisyon na pinirmahan ni Judge Villanueva “convenientlt lambasted” Acting Executive Judge Angeline Mary Quimpo-Sale ng Regional Trial Court of Quezon City, na nag-isyu ng search warrant.

“The Agency is now assessing and evaluating the pieces of evidence available against Yu and will pursue the necessary course of action or remedy against the Decision such as filing of Petition for Certiorari, under Rule 65 of the Revised Rules of Court on the ground of grave abuse of discretion amounting to lack or excess of jurisdiction,” pahayag ni Aquino.
