Kris, kinasuhan ng 9 na cyberlibel si Atty. Jesus Falcis III
PUMUNTA nitong Huwebes nang hapon sa Department of Justice (DoJ) si Kris Aquino, kasama ang legal counsel niyang si Atty.
Ricky dela Cruz, ng Divina Law, para isampa ang nine counts of cyberlibel laban kay Atty. Jesus Nicardo Falcis III, kapatid ni Nicko Falcis II na dating managing director ng Kris C. Aquino Productions (KCAP).
Matatandaang tinawag ni Atty. Jesus ng “liar” si Kris sa kanyang Instagram post nitong Nobyembre 16, na siyempre pa ay hindi nagustuhan ng Queen of Social Media.
Post ni Atty. Jesus: “Kris the liar says the credit card charges were unauthorized personal expenses of my brother. Personal expense pala ng kapatid ko ang Cathay Pacific flight mo and pag-stay mo sa Marco Polo Hotel, Ms. Aquino? Pati entourage mo personal expense ng Kuya ko?“Grabe ka naman! Ikaw
ang gusto magsama ng 10-20 people tapos gastos pala ng Kuya ko ‘yun? Sagot pala niya sina Alvin, Bincai, Jack, at iba pa??? Haha, si Kuya na pala boss nila!
“P.S. Sa mga feeling omniscient, 3 lang ang sponsored ng Cathay—sina Kris, Josh, and
Bimb—under their contract. Mahiya ka sa balat mong urticaria-prone, na alam mo na meron ka even before ka nag-Singapore!”
Isa sa naunang ipinost pa ni Atty. Jesus ay ang artcard ng isang babaeng naka-raincoat na may dalang payong na nasusulatan ng: “Some people create their own storms then get upset when it rains.”
Ang caption ng post: “Hey Rich Girl Gone Crazy ala Gone Girl, don’t be a spoiled oligarch brat. No SPA, no meeting? No mom, no meeting? No immediate compromise, no settlement? Ano ka, hello? We weren’t born yesterday noh.
“Una, walang ninakaw. Ikalawa, ikaw binantaan mo buhay niya. Baka ano na namang sakit makuha mo ‘pag kami na naglabas ng mga ALAS namin. Ikatlo, fighter kami, lalo na Mom namin.
“If you’re going to go back to your strategy of using your PR connections to defame him, be careful what you wish for, you just might get the publicity you so crave.
“Remember, kay Duterte nga di ako takot, eh. Ikaw pa kaya?”
Sa iba pang post ni Atty. Jesus, idinamay din niya ang mga namayapang magulang ni Kris na sina ex-Senator Benigno “Ninoy” Aquino, Jr. at ex President Corazon C. Aquino.
“By the way Ms. Aquino, how were the Bon Chon, Jollibee and Pancake House that you ate? It’s hard to be the child of Ninoy and Cory. But your other siblings turned out okay. Why did you turn out that way?”
Halos lahat ng nakabasa sa mga post ni Atty. Jesus ay iisa ang komento, na mistulang binubully niya si Kris.
Hindi naman pinatulan ng KCAP CEO/ President ang mga pambu-bully na nabanggit, at sa halip nga ay naghain siya ng reklamo sa DoJ.
“Offensive and humiliating” para kay Kris ang mga posts ni Att. Jesus, batay sa naging panayam sa kanya ng Politiko website.
“While I am a well-known celebrity, respondent does not have the unbridled license to malign my honor and dignity by indiscriminately posting malicious statements against me,” ani Kris.
“If the utterances are false, malicious or irrelevant to matters of public interest involving public figures, the same may give rise to criminal and civil liability,” dagdag pa niya.
Batay sa Republic Act 10175, or the Cybercrime Prevention Act of 2012, ang parusa sa mapatutunayang guilty sa paglabag ay “one degree higher than those provides for in existing laws for crimes committed with the aid of a computer or other similar means.”
“Ms. Kris respects our prosecutors and she now leaves it to them to start the legal process. We believe that Ms. Kris Aquino will get JUSTICE because TRUTH IS ON HER SIDE,” saad naman sa pahayag ni Atty. Dela Cruz.
Ang nasabing reklamo ay tinanggap ni Senior Deputy State Prosecutor Richard Anthony D. Facullon, ng National Prosecution Service Department of Justice, Manila City.
Nananatiling bukas ang pahinang ito para sa panig ni Atty. Jesus at ng kanyang pamilya.
