Gapo mayor, VM inireklamo ng graft

Nahaharap ngayon sa kasong kriminal si Olongapo City, Zambales Mayor Rolen Calixto Paulino, bise-alkalde nito at siyam pang konsehal kaugnay ng umano’y pagkakadawit sa maanomalyang pagpapaarkila at pagpapaunlad ng Olongapo City Civic Center (OCCC), noong 2014.

Kasama rin sa kaso si Vice-Mayor Aquilino Cortez Jr., at mga konsehal na sina Elena Calma Dabu, Benjamin Cajudo II, Eduardo Guerrero, Noel Atienza, Alruela Bundang-Ortiz, Edna Elane, Emerito Bacay, Randy Sionzon, at Egmidio Gonzales, Jr.

Ang mga ito ay ipinagharap ng kasong paglabag sa Section 3(e) ng Republic Act 3019 (Anti-Graft and Corrupt Practices Act).

Hindi rin nakalusot sa kaso sina Tony-Kar Balde III, ng City Planning and Development Office, Cristiflor Buduhan, ng Office of the City Accountant, Anna Sison, ng Office of the City Legal Officer, Mamerto Malabute, ng Office of the City Administrator, Department Head II Joy Cahilig, ng Office of the City Budget, at pawang miyembro ng Special Bids and Awards Committee (SBAC).

Sa complaint-affidavit, ginamit umano ng mga ito ang kanilang posisyon upang mapadali at ang paga-award ng lease and development ng OCCC contract sa SM Prime Holdings, Inc. (SMPHI), mula Oktubre 2014 hanggang unang tatlong buwan ng 2015.

Hindi rin umano sumunod ang mga ito sa mga probisyon ng Republic Act 6957 (An Act Authorizing the Financing, Construction, Operation and Maintenance of Infrastructure Projects by the Private Sector, katulad ng inamyendahang Republic Act 7718 at sa Implementing Rules and Regulations (IRR) nito.

Ayon kay Graft Investigation and Prosecution Officer III Jane Ong, hindi sinunod ni Paulino ang Section 10.8 at 10.9 ng IRR ng naturang batas kung saan kinakailangan ng endorsement ng proposed unsolicited project sa Investment Coordination Committee at sa National Economic Development Administration (NEDA) at ang pagsusumite ng draft lease agreement sa Office of the Government Corporate Council (OGCC) para sa masusing pag-aaral.
