Quarantine breach case vs Pimentel, ibinasura

Ibinasura ng Department of Justice’s Office of the Prosecutor General (DOJ-OPG) ang isinampang reklamo laban Senator Aquilino Martin “Koko” Pimentel III kaugnay ng umano’y paglabag sa quarantine protocols noong Marso ng nakaraang taon.

“The Office of the Prosecutor General, DOJ, resolved to dismiss the complaint against Senator Koko Pimentel for violation of Section 9(e) of Repubic Act No. 11332 or the ‘Mandatory Reporting of Notifiable Diseases and Health Events of the Public Health Concern’ for lack of probable cause,” pahayag ni OPG spokesperson Prosecution Atty. Honey Delgado, kahapon.

Kaugnay nito, dismayado naman si dating University of Makati law dean Rico Quicho kaugnay ng nasabing

hakbang ng DOJ-OPG.

Si Quicho ang nagsampa ng reklamo sa DOJ laban kay Pimentel noong Abril 6.

“Got the news that DOJ let Sen. Koko scot-free. Bulag, pipi at bingi ang DOJ. Taumbayan na ang huhusga,” ang bahagi ng post ni Quicho sa kanyang Facebook account, kahapon.

Nag-ugat ang kaso nang samahan nito ang buntis na asawa na si Kathryna sa Makati Medical Center (MMC) noong Marso 24. Nanganak ang misis nito noong Marso 29.

Naiulat na namili rin si Pimentel sa S and R supermarket na nasa Bonifacio Global City (BGC) sa Taguig City, noong Marso 16.

Sa nasabing insidente, binatikos ng MMC si Pimentel dahil naka-selfquarantine dapat ito nang ikonsidera itong pinaghihinalaang nahawaan ng 2019 novel coronavirus disease.

Matapos ang pagtungo sa nasabing pagamutan, kaagad na kinumpirma ni Pimentel na positibo ito sa nasabing virus.

Nang isampa ang reklamo, itinalaga si Assistant State Prosecutor Wendell Bendoval na magsagawa ng preliminary investigation sa usapin.

“Senator Koko Pimentel is not a public health authority (i.e. he is not the DOH [Department of Health], the RITM [Research Institute for Tropical Medicine], the Epidemiology Bureau), therefore, not obliged to report under R.A. No. 11332. The mandatory reporting under R.A. No. 11332 was meant for public health authorities only,” ang bahagi ng 19 pahinang resolusyon ni Bendoval sa kaso, ayon kay Delgado.
