DOJ: Aplikasyon sa amnestiya, sasalain
Ang mga miyembro ng mga rebelde at komunistang grupo ay maingat na susuriin bago ang pagbibigay ng amnestiya sa ilalim ng mga proklamasyon ni Pangulong Rodrigo Duterte na ipatutupad sa pagsang-ayon ng nakakaraming miyembro ng Kongreso.
Sinabi nitong Miyerkules ni Department of Justice (DOJ) Secretary Menardo I. Guevarra na: “the most fundamental criterion (in amnesty grant) is whether or not the offense committed by the subject individual was in pursuit of a political objective.”
Gayunpaman, ang amnestiya sa ilalim ng mga proklamasyon, ay hindi ibibigay sa mga naakusahan sa ilalim ng AntiTerrorism Act (ATA) of 2020 ng bansa.
Hindi rin kasama sa amnestiya ay ang mga krimen tulad ng kidnap for ransom, massacre, rape, terrorism, grave violations ng Geneva Convention of 1940, genocide, crimes against humanity, war crimes, torture, enforced disappearances, at iba pang gross violations ng human rights.
“I will ask the national prosecution service to do an inventory of cases pending investigation and/or trial involving these classes of people covered by the amnesty proclamations,” sinabi ni Guevarra.
“But dismissals of these cases are not automatic,” ipinunto niya.
Ang mga proklamasyon ng Pangulo na inilabas noong Pebrero 5 ay nagbibigay ng amnestiya para sa mga kasapi ng Moro Islamic Liberation Front (MILF), Moro National Liberation Front (MNLF), ang Rebolusyonaryong Partido ng Manggagawa ng Pilipinas / Revolutionary Proletarian Army/Alex Boncayao Brigade (RPMP-RPA-ABB ), at mga dating rebelde sa ilalim ng komunistang teroristang grupo.
Lumikha rin ang Pangulo ng isang komisyon na tatanggap at magpoproseso ng mga aplikasyon para sa amnestiya, at upang matukoy kung ang mga aplikante ay karapat-dapat sa amnestiya sa ilalim ng mga proklamasyon.
Sinabi ni Guevarra na “the Amnesty Commission will still determine the rules” at “persons who may be eligible for amnesty shall be carefully screened and evaluated by the Amnesty Commission to determine if they actually qualify for amnesty which, incidentally, requires the concurrence of the Congress.”
Ang mga kasapi ng mga rebelde o pangkat ng komunista ay maaaring maghain ng aplikasyon para sa amnestiyo kung ang mga krimen ay nagawa bago ang paglalabas ng mga proklamasyon, aniya.
Sinabi din niya na ang isang aplikante ay dapat na aminin ang kanyang pagkakasala sa pagsulat at sa ilalim ng panunumpa, pati na rin ang pagsuko ng anumang baril at paputok sa mga awtoridad sa pag-apply para sa amnestiya “without incurring liability for illegal possession.”
Sa ilalim ng mga proklamasyon, ang mga krimen na saklaw ng amnestiya ay: rebellion, conspiracy and proposal to commit rebellion, disloyalty of public officers or employees, inciting to rebellion or insurrection, sedition, conspiracy to commit sedition, inciting to sedition, illegal assembly, illegal association, direct assault, and indirect assault, resistance at disobedience to a person in authority or the agents of such person.
Saklaw din ang mga kaguluhan at iba pang panggugulo sa public order, unlawful use of means of publication and unlawful utterances, alarms and scandals, illegal possession of firearms, ammunition or explosives provided these offices were committed in connection with rebellion; at mga kinasuhan, idinetine, o nahatulan ng mga karaniwang krimen ngunit mapapatunayan sa pamamagitan ng malaking ebidensya na gumawa sila ng mga krimen sa pagsunod sa mga paniniwala sa politika.
