When asked whether he would go out of the Senate premises where he is holed up Trillanes replied, “The advice given to me by my lawyers and the Senate leadership is not to make it easy [for them to arrest me].”

Senate President Vicente Sotto 3rd on Wednesday took custody of Trillanes pend-

ing the issuance of arrest order against the latter.

Trillanes questioned the “basis” of the Department of Justice’s move to have an arrest order issued against him.

He maintained that the coup d’etat and rebellion cases against him were both dismissed in 2011.

Trillanes said he could no longer be subjected to court-martial proceedings because he was already a civilian when he resigned from the Armed Forces of the Philippines (AFP) and later ran for and won a seat in the Senate in 2007.

The senator made the remark in reaction to a statement of AFP spokesman Col. Edgard Arevalo that he needed to undergo court-martial proceedings again after the President’s revocation of the amnesty granted to him eight years ago.

- ments “to negate” the position of the AFP that he will be again subjected to such proceedings, showed that he received his last salary as a soldier on March 1, 2007.

“As early as May 3, 2007, I was already issued general orders by the AFP in relation to my resignation from the service. This set of documents shows that I am no longer

part of the AFP since 2007. They don’t have any more jurisdiction over me. I’m already a civilian,” he said.

Trillanes told Arevalo “to step back” and study his documents.

“We have to dig our records. They should no longer waste their time. It’s absurd to begin with. So, I will give these documents to them,” he said.

Meanwhile, election lawyer Romulo Macalintal said a military tribunal could not resume or reacquire jurisdiction over Trillanes in connection with the revocation of the amnesty granted to him by Aquino.

“Trillanes is no longer in the military since he was automatically resigned from Macalintal said in a statement.

“Hence, the PNP (Philippine National Police) and the military cannot arrest Trillanes on mere order of the President since the latter has no power to order the arrest of any person without a warrant of arrest issued by a competent court having jurisdiction over added.
