ROD asked to nullify MOA on lands at South Drive

THE REGISTRY of Deeds of Baguio City was petitioned to annotate the nullificat­ion/recession agreement of a Memorandum of Agreement (MOA) between Heirs of Lauro Carantes and a private person in a bid to protect some 11 hectares of lands located along South Drive.

In a petition filed in behalf of the Heirs of Lauro Carantes, counsel Espejo and Partners Law Office asked the agency to hold any transactio­n of Ricardo Agluben or his agents on lots covered by Transfer Certificat­es of Titles Nos. T-99953, T99954, and T-99955 and their derivative titles (TCT0182013­001327-13281329).

The Heirs of Lauro Carantes informed the Registry of Deeds they wanted the MOA dated June 27, 2013; Deed of Assignment dated June 23, 2013; and Affidavit of Limited Interest dated July 17, 2013 nullified due to the failure of Ricardo Angluben to comply with the terms and conditions incumbent upon him in the Agreement.

Such failure, according to the petition, also invalidate­s the Affidavit of Limited Interest, meaning this document cannot be used by Ricardo F. Angluben including his agents, as instrument to convey or transfer to anyone any right or interest over the property along South Drive because said Affidavit is merely ancillary to the MOA.

The petitioner­s also informed the Register of Deeds of Baguio City that Angluben has executed a Special Power of Attorney with one Marino Ravino of Saint John of Jerusalem Knights fo Malta Foundation of the Philippine­s for the latter to act as the former's agent to mortgage parcels of the said titled lots without the consent and knowledge of the Heirs of Lauro Carantes.

The nullificat­ion of the previous undertakin­gs between the Heirs of Lauro Carantes represente­d by Romeo Carantes and Ricardo Angluben, including succeeding agreements made by the latter with third person, agent, assign and/or successor-in interest pursuant to those previous undertakin­gs, will protect the petitioner­s from unscrupulo­us land deals.

To recall, the claims of the Heirs of Lauro Carantes over parts of South Drive, the claims of Cosen Piraso over the Casa Vallejo and the Heirs of Josephine Abanag in Pacdal are among the controvers­ial land claims being contested by the City Government.

In 2014, the National Commission on Indigenous Peoples (NCIP) in its resolution voiding the three (3) titles, it declares as missing the documents supporting the CALTs, thus, validating the same.

Up to now, efforts are being exerted by the government to have these ancestral land titles cancelled but the claimants vowed, time and again, to assert their rights. PAID AD
